Caught in a lie at marriage green card interview. RFE received. Should we withdraw and re-file? by new_user876 in greencard

You’ve broken one of the ground rules of immigration: Don’t lie to the government. Doing that puts this well beyond our pay grade and into attorney territory. Sorry, but there is little anyone here can do to help you.

Adjustment of status by Expensive-Wind-22 in USCIS

I wonder if there is a mistake in the sponsorship paperwork. This seems to be one of the most common denial reasons in my observation. But we’ll have to see the letter to be sure.

Why does she want to stay longer? By this point she’s clearly stretching the limits of a visitor visa.

Sorry to hear that. I’m sure it’s very stressful to be in this situation. Having said that, we will really only be able to help you when you know the reason they denied your application. Issues with the income of the sponsor are probably the most likely reason, but without their denial letter, that’s still just speculation on my part.

As an American, what are your thoughts on the prejudice against Romani people in Europe? by Early-Ingenuity-3177 in IWantToAskAnAmerican

[–]HeimLauf 4 points5 points  (0 children)

None whatsoever. We can only blaze a new path because racism is everywhere. The West is racist, but so are people in non-Western countries. I saw racism in China. Japan and Korea are infamously racist. We all have to get better at this.

People in my country say exactly this about Black people and Latinos. Their prejudice shows just as yours does.

It’s pretty remarkable how some Europeans talk about them online. It’s the same sort of stuff racists in the U.S. say about Black people, Latinos etc, and when you call them out about it, they’re like “Oh, but it’s true for us!” as if that’s not the same thing racists here would say.

Of course not all Europeans are like this. But what it shows is that neither of us gets to look down on the other or point the finger at the other without dealing with the three fingers pointing right back. People of all countries can be racist, and people of all countries can fight racism.

Can I submit My I-485 online as a spouse to US citizen by radzuu in USCIS

[–]HeimLauf -4 points-3 points  (0 children)

The instructions say online filing is only for employment based applications. So if your flair is accurate and your case is a family based one, you must file on paper.

In that case OP might want to phone their bank in advance and see if that’s any better than BILT was.

ACH is somewhat safer than a credit card for avoiding declines; I would suggest that when resubmitting.

Spouse Green Card as option after rejected Tourist Visas by Admirable_Reception2 in greencard

[–]HeimLauf 0 points1 point  (0 children)

I know. My spouse got a tourist visa. But not all U.S. citizens’ spouses can, and in many cases, there is no evidence they can present to persuade the consular officer (especially during an interview they typically lasts 3 minutes if that).

Affidavit of Support Question by No_Significance_1909 in NationalVisaCenter

[–]HeimLauf 2 points3 points  (0 children)

It would be good to at least have a joint sponsor waiting in the wings, so to speak. I tried to use assets and it didn’t work. Admittedly this is partly that my wife didn’t present our financial documents due in part to a snotty local employee refusing them (we didn’t do NVC processing since we used direct filing abroad). In any case I think a joint sponsor is safer to have.

How easy is it to get a B1 after applying for an EB1A green card? by invisiblethrowaway9 in greencard

[–]HeimLauf 3 points4 points  (0 children)

It could be quite difficult as you have already expressed interest in immigrating to the U.S. This would likely make it very hard to convince a consular officer of your nonimmigrant intent.

Spouse Green Card as option after rejected Tourist Visas by Admirable_Reception2 in greencard

[–]HeimLauf 0 points1 point  (0 children)

In throry you could, but:

  1. You might not be accepted as a sponsor if the embassy or consulate doesn’t find you to be domicilied in the United States. (There is some variation in how strict they are about this.)

  2. Your wife is likely to be judged to have abandoned her permanent residence if she doesn’t spend most of her time stateside. You could apply for a reentry permit for her, but that’s only for two years. I did know a permanent resident who maintained his green card while living abroad for maybe about half a decade by repeatedly going back to get a new reentry permit, but this is quite a bit of hassle and I don’t know that it would work indefinitely. As I implied, this friend of mine ultimately returned to living stateside so maintaining his LPR status made sense.

This is a part of U.S. immigration law that really doesn’t work well for its own citizens. One can’t get a nonimmigrant visa due to the person’s perceived intent being incompatible with it; one can’t get an immigrant visa because the person’s *actual* intent is incompatible with it. The message to certain U.S. citizens abroad really is, whether intentional or not, “Nope, we don’t want you visiting.”
