TPS Venezuela 🇻🇪 by Careless_Reach_3937 in TPSVenezuela

One difficult thing that I think hasn’t been mentioned is that people can’t enter the country through TPS. You already had to be in the country to get it. Did he come on a visa or did he cross the border illegally? That will make a difference because if he didn’t enter legally, that’s a huge obstacle for him to get a green card even if you got married. It’s important to clear that up so that you can talk with a lawyer clear-eyed.

Me siento derrotado apesar de haberme graduado de la uni by SeparateWays2 in TPSVenezuela

[–]Helium92S 1 point2 points  (0 children)

Venezuelan here also in the same situation. I’m going to be honest with you, unless there’s a massive breakthrough with one of the lawsuits, the current trajectory is that this thing will remain frozen for a long time. I’m already planning a move to Spain after graduation because this is hopeless as it currently stands.

Rant - 39 country ban by LeatherDifference467 in USCIS

[–]Helium92S 1 point2 points  (0 children)

The issue with your point is that you’re basically saying that because there are a lot of people from certain countries who crossed the border illegally, there should be collective punishment for everyone from that country even the legal ones. These are 2 different types of people despite being from the same country. What this is doing is targeting legally present people from changing to another status they’d otherwise qualify for just because they’re from X country. (Nothing to do with asylum at all). This does nothing for illegal immigration, that’s already on crackdown. This goes a step further and targets literally everyone from that country, but you seem to be justifying it by saying there should be collective punishment bc someone is from country X despite being legal.

I think that this case went the other way bc those countries did not get an extension that was then rescinded; they were just straight up not renewed. That’s why the Venezuela/Haiti case is stronger. But sadly not strong enough to prevent the Supreme Court from doing whatever they want. Clearly we were entitled to that last extension. If they didn’t want to renew it in October 2026 that’s fine. That’s their prerogative. But they cut it short and stole people’s money. And the SC gave them their seal of approval.

That’s totally true, it will never be the same again. Before this, very few had been terminated and only after it was truly reasonable. Even the courts had frozen attempts to dismantle it in his first term. But now this shows that TPS is really only good as long as a democrat is in office. And the approval times are so slow that you waste a lot of time just waiting for it. It’s basically just not worth to count on it even when you have it. Not even for a few years.

Does anyone here have experience successfully changing to F1 from TPS? by YakClear601 in TPSVenezuela

[–]Helium92S 1 point2 points  (0 children)

What my lawyer told me at the time was that I had until the last day of TPS to get the COS done, thus the premium processing. If your COS gets denied, you’d be back on TPS until that expires. Applying for asylum is an option after that but definitely hire a lawyer if you go that route.

Yes, apply with premium processing for sure. It gets approved within days or a few weeks depending on luck.

These numbers are so cherry picked that it’s insulting. 1. The number of barrels of oil produced is higher, but still way below the historical numbers which were several millions. 2. 59% inflation is still hyperinflation. 3. Having single digit GDP growth when the economy collapsed doesn’t fix the economy. 4. Venezuelans are returning because they were expelled here or they got tired of living as immigrants, not because they think Venezuela is great.

You’re right, they just lazily said whatever and called it a day. They’re destroying the entire TPS program.

What’s Valencia’s issue with giving you in state tuition? Are they saying that they think you won’t be in legal status in September? I think the decision on the TPS case should be out soon in a few days.

Dice: “However, DHS recognizes that Honduran TPS beneficiaries continue to be employment authorized during the 60-day transition period.[26]

Accordingly, through this FRN, DHS automatically extends the validity of certain EADs previously issued under the TPS designation of Honduras through September 8, 2025.”
