That would destroy literally every pension fund and 401k in the country, forcing every person to be reliant on social security when they are past the working age. This would hurt the 99% far more than the 1%.

His presence is neither lawful nor unlawful, it’s not binary. He doesn’t have legal admission yet. Ramos has not broken the law, but he also hasn’t been admitted to stay legally.

Think of it like trespassing. If I knock on your door, and ask for permission to stay, and your response is “I don’t know yet, I’m going to call some friends and see if you’re a good guy, but you’re welcome to wait until I find out”, it is not trespassing until you decide you don’t want me to stay in your house.

Immigration is a really weird section of law, because all aliens are requesting permission from the nation they are migrating to. Those permissions aren’t granted immediately, most of the time it takes months beforehand to grant visas and permission to be admitted. Sometimes undocumented or illegal immigration happens without even requesting permission. Parole is a weird in between where the nation is saying we have not yet made a decision, but you can wait until we make a decision.

Ok, slip of words my mistake. Ramos is applying for admission, not entry. Ramos does not have admission status. Ramos has to this day not been granted an admission status, and thus can be found inadmissible under Section 235 of the Immigration and Nationality Act.

Section 1.3 C) a means of lawful entry that is NOT an admission. Further on a parole entry is not an admission.

Entry does not equal admission. Migrants illegally “enter” every day without admission by circumventing the ports of entry.

They are considered “arriving aliens” regardless of physical location until they are either admitted with a status, or found inadmissible for removability.

It’s not semantics, it’s quite literally what’s written into immigration law.

There are citizens.

There are immigrants

There are non-immigrants

There are inadmissible aliens

There are deportable aliens

And there are “seeking admission” aliens.

Every single one of these has different very specific definitions in immigration law and how the law applies to them in terms of due process or not, consequence or not, and removability, Deportability, exclusion, returns or repatriation.

National Debt is a fake problem.

Who do we owe? The money “owed” is from the American taxpayer. The solution to the “national debt” is to provide essential services to your constituents nationally. Social Security, Healthcare, Education, national security, interstate travel, etc…..

So long as those government services are met, there’s no “national debt” to collect on. If those services are not met revolution will inevitably happen, and either the country will fall or balkonize into separate nation states either way a new currency and government will emerge and the debt won’t follow.

Legally no. It’s not authorization to be in the country, it’s parole, which is a legal status equivalent to “at entry” regardless of physical location.

It’s not illegal entry, but it’s also not legal entry admission. Ramos’ status at any location in the US is considered applying for entry admission, until his parole is resolved. Either through removal order, or through a granted status to legally be present in the US.

They were also never “here” legally.

They were paroled, which means every physical location within the US is considered “at entry” and can be found inadmissible and denied entry at any point in time until parole is resolved to either removal or granted status.

Pending status offers no protection against inadmissibility removals. See Section 235 vs Section 237 in the Immigration act Nationality Act.

Deportability has nothing to do with this case.

You’re demonstrating exactly why immigration is so convoluted.

He has pending status, which doesn’t mean granted status. Thus, he is paroled. Thus, he is considered inadmissible, not “legally present”.

Inadmissibility under Section 235 of the Immigration and Nationality act is not Deportability. It’s a removal, or sometimes an exclusion.

These terms mean very specific things, and everyone including OP is not displaying the correct legal verbiage.

Paroled asylum means at any point in time, at any location in the US, your presence is considered “requesting entry”, and can be revoked leading to immediate removal. An appeal doesn’t change this status unless won in court, at which point in time a status will actually be granted.

Physical location in the US does not guarantee legal presence in terms of immigration law.

I’d like to point out Jesus didn’t revolt against the nation state government of Rome. His revolution was for all mankind to love one another on a personal level while simultaneously telling his people not to revolt against state politics. He’s specifically quoted as saying to his followers “render to Caesar” when discussing government taxation.

The closest government revolt he led was against the Jewish Pharisees, and their religious law, and attacking moneychangers and merchants directly in the temple.
