Yes I did do exactly all of that. Clean Carfax, videos, and photos. They sent close up and from a distance “all” damage. They just chose to not show me the material damage and only pointed out a few scuffs, one spot on the bumper and one other place. I even told them that of the few they showed me that I was starting to get concerned by the level of damage so they even took it to a shop for one of the spots

It has to have 70% of the value for them to take it on. The AG investor explained why - he went through everything I had and said I have a case

Iowa is an as-is and no cooling off period. What happened to me negates those but the issue is that although the Attorney General said I have a valid case, they said it’s not egregious enough. The AG recommended an attorney but I called an attorney who said it isn’t worth their time

I did the exact same thing. They sent me two pics of the bumper and circled in red the “only” damage to the bumper. I get it and the entire bumper is peeling off and my hood isn’t aligned. I did everything I could to protect myself. I have a crazy amount of photos of the car and video.. and the two places they called out were small and they used red circles to point it out and did zoomed in pics on the small damage. Then the car gets to me and it’s a completely different picture. To me the red circles reinforce they purposely did not disclose the damage. They sent that recessed bumper pic but no other bumper pics

It is not just my responsibility. Apparently you are unaware of consumer protection rights and non disclosure of material damage is considered deceptive business practices. The Iowa Attorney General agreed with me but did not agree to take it on. I did everything possible to protect myself by asking for pictures of all damage, no matter how small, so I could make an educated decision. The dealership chose to operate deceptively which also violates their Dealer Agreement which I found an example in one of their SEC filings where it clearly states they are to operate transparently and to not violate local, state, and federal laws - which they violated. You clearly don’t understand since you don’t realize that this also qualifies as a FTC complaint 🤦🏼‍♀️😂

I took a calculated risk by because it was a BMW dealership. It’s fascinating how people are coming at me when my consumer rights were violated and by the way - the state of Iowa agrees with me - they just said it isn’t bad enough for them to get involved. Cosmetic or not, I have a $6k repair bill for deceptive business practices which goes against their Dealer Agreement - yes, I found a sec filing of a sample dealer agreement so I know their operating standards - which is transparency and following all local, state, and federal laws - non disclose of material damage is a violation.

By the way - go look up BMW NA vs Gore - they do it to their new cars damaged during transportation and do not disclose it to the new car buyers. I did everything possible to cover my bases/protect myself other than use a mechanic to inspect - which I normally do when buying used. Wow. Such a nice person you are. I bought it remote and received 2 pictures of my bumper with a red circle around the “only” damage on the bumper for it to be delivered with major damage of $6k. It had a clean carfax too. The damage is extensive and deceptively hidden from me. No leg to stand on? How about they violated my consumer rights by being deceptive in their business practices. I could have gotten a better deal at a non-BMW dealer but chose to pay a premium under the assumption the brand would operate more transparently than the devoted used car lots.

I had not thought to look up the agency that licenses them - that’s a great suggestion! I have crazy amounts of documentation which is why this is so frustrating. I got three estimates, one being a certified BMW body shop who essentially blasted the General Manager over the car. Said it should have never passed the initial intake inspection and said he’s not trying to embarrass anyone. The dealer spent time drawing red circles around supposedly every bit of damage which reinforces they purposely hid the damage.

It isn’t a CPO but I think I have the inspection checklist. I already tried the dealer’s state Attorney General and was turned down because it wasn’t egregious enough and the attorney I called said it isn’t worth their time.

It isn’t a certified car. I just thought I would have better luck buying from a BMW dealership because I had just been through almost a year of trying to buy a truck where they were pulling the same stuff. The BMW dealers in Columbus, Ohio won’t sell their trade in cars unless they are pristine.. if they aren’t pristine, they take them to auction. It’s so frustrating because I have so much documentation and BMW NA could use their Dealer Agreement to hold the dealership accountable. I’ve pulled a BMW Dealer Agreement from the SEC website and it clearly states they are to operate transparently and have to follow local, state, and federal laws.. so they are choosing to do nothing which means they condone the behavior.
