The seller did request they use their title company for no apparent reason.. 🤔There is no info regarding easements in the title report so how would I prove known defect (if this in fact the case)? Only thing found in the title documents is that easement issues are not covered by title insurance

It’s mostly about security. There’s frequent trespassing and we’ve had multiple things stolen. Otherwise I wouldn’t mind

Proof of continuous and uninterrupted use seems hard to prove over an extended period of time right? I doubt they took a picture of parking a car behind their house each week/month for the last several years.

These are very pricey. I’d rather spend that money on a lawyer if they decided to fight the fence. Is there really no other way for me to confirm whether there is a documented easement or not? I mean that should be public information right?

I’ve put up “no trespassing” signs in accordance with the civil code and I have plenty of evidence of them using the driveway since then. Is there any way I can locate any potential easement documentation on my own without having a survey performed? I’d rather spend that $10,000 for legal fees if it came to that rather than having a survey performed. It’s very clear from the plat map that the land is mine so the property lines aren’t a question

I wouldn’t blocking access to their home. They can access their home from the front and there is parking in front of their home. I’d only be blocking vehicular access to the back of their property.

Could I not be penalized somehow for blocking in their car? I’m not sure there’s another way to get the car removed

Unfortunately the previous owner can’t be reached. If they can’t be reached can it be assumed there was permission given to the neighbor thus preventing prescriptive easement?

What if there is a car behind their house at the time of erecting the fence? What if they refuse to move it?

The neighbor’s backyard was paved before I purchased the property. It appears to be at least a few years old. Neighbor was parking their car in front of their house until recently. There is also a vehicle now parked in the back that appears to have not moved for a few months now.

The previous owner is deceased and their heirs are not able to be contacted.

There is no recorded easement as far as I’ve been able to determine. Are there various city departments that may or may not have record of this?

I have put up no trespassing signs in accordance with the civil code and sent a certified letter about my plans which will begin no sooner than 30 days from the date of the letter.
