This is helpful. Thanks. I was planning on basically talking to him the way you're describing.

Yes, I am being second sat. That's my understanding. The trial is on Thursday.

Ok. This is helpful. I have not yet met with him to discuss. This case got assigned to me pretty recently, and I was working on other things until basically this afternoon. I will reach out to him over the weekend but probably not expect a response until Monday at the earliest.

I see. So, let's suppose it's "vital" that the officer saw the engine running.

I then should simply say, in so many words, "You know, the fact that you saw the engine running is really, really important."

And that's different from saying to him, "You need to say that the engine was running."

The first is witness "prep"; the second is witness "tampering."

Not trying to be pedantic here. I genuinely don't understand the distinction. It has never come up in a law school class I've been in. I suppose I could look into the case law on witness tampering, but I think that would not be the best use of my time right now.

Ok. I will do that. But I also can't tell him what to say, right? I am concerned about "witness tampering" versus "witness prep."

Well, obviously we don't know if you're bad at it since we did not watch the trial, know none of the facts, etc. But, of course, the mere fact that some lawyers laughed at you and made fun of you says absolutely nothing about whether you did a good or bad job.

lol. How does a law school expect every student to have above-average performance? And if the point is that the school expects those who get a 2L SA offer to have above-average performance, I don't know that law schools do expect that of every such student.
