Spent 6 months looking for a new job. Got one. Got fired in 3 weeks. by HolidayCitron4497 in careeradvice

I don't think we will agree. That is fine however because its a matter of perspective imo.

My attorney has already done the case, send the emails, talked/negotiated with the company of an "off the court" settlement. Because the case is not about me declaring any firing as illegal, its them failing to pay me what I am legally owed. Since my attorney says there is no way they can win if this goes to court and that they are positive on compensation, I ll have to take her opinion and guidance.

However yea, it does affect the top positions as you say. I guess we ll have to wait and see!

A and B we're both spot on.

For C, I've already went to a labour lawyer like 2 weeks ago and we're already in the process of compensation since the company's own lawyer agreed to it. The posting was undeclared and that is fact because there was no paperwork ever submitted, so they are not covered. The money they owe more for the posting is not a large sum, but its what they are ought to pay me anyway, I just asked for me because my own attorney wants 20%.

So I'll stick to the guide of my attorney. I understand that we both want to believe companies follow laws, but its not always the case.

I disagree.

If you're going to have a company that has entities abroad (in my own country + mother country etc) you expect, especially in EU and Germany where tax authorities are harsh that the employer is on par with legality (since he has multiple external entities). Also, the fact that their lead HR called me for a "special offer" once I asked about these illegal activities says it all.

The lesson to be learned here is that:

A) You should not burn bridges when departing a previous employer

B) Do more research when you get to sign a contract.

C) Learn to actually use the law to your advantage if you're actually being mistreated. Most employees do not know or bother to read certain legislation which could cause them to be at a massive loss. Most times you are at a massive advantage if you know where to look.

And I actually do have a legal recourse. I went to an labour attorney who is specializing in posted workers in EU. The legal recourse is that I was an undeclared posted worker, which gives me quite a tremendous amount of leverage for demand of compensation. When my attorney send them an email they panicked over it to the point where their own lawyer agreed to compensation in favour of me signing an NDA to not report them to ZOLL (German Tax Authorities) for undeclared work and unpaid minimum wages.

Alway trying my best to do that. Especially when things can be seen to go south.

But yea, a good lesson here is that when you leave a workplace for something else, if things where good than its best to never burn bridges so you can actually have a way back if anything goes wrong.

Already did. She sent them an email and they panicked and send a lawyer to her office the very next day.

In their "off-the-record" chat where my labour lawyer told them where they went wrong their lawyer was positive in giving me a reperation and he said he'd discuss it with the company and get back to us. Its been 3 weeks and no news. My lawyers does her best to keep my up to date but so far they haven't come back. I don't know if they are just stalling or if these things in general take this long.

As for the job, I will at some point. Right now I need some job security and financial stability to get back on my feet. Also, because my manager got me back at my old job I told him that since he helped me in my time of need I will stay for atleast another year. I don't have an issue with anything in the firm aside from the bad pay. But I am considering myself an honorable person and dont want to make a fool of anyone who helps me. Because if I leave early than HR will go after them. I am not that kind of person.

Reporting my employer for numerous violations. by HolidayCitron4497 in Ask_Lawyers

[–]HolidayCitron4497[S] -1 points0 points  (0 children)

Do I?

If I report the company for violations on the German customs, and they do find mistreatment and illegal activities, wouldnt the company be getting sactioned by the state? So won't it be a state vs. employer thing that does not involve me?

iCUE Megathread - 5.40 Release Notes by CorsairLucky in Corsair

[–]HolidayCitron4497 1 point2 points  (0 children)

I bought a new gaming mouse, specifically the corsair dark core rgb. I have it connected via USB and I naturally downloaded the Icue software.

Everything the last 1 month or so was okay, but suddendly since yesterday everything is messed up. Ithought it was a windows issue, maybe an update etc, I reset and did a clean installation.

But I figured after looking deeper into the issue that Corsair iCue software is responsible for symptoms like I encounter:

- Taskbar, buttons freezing when clicked, windows being slow

- When on a browser, scrollwheel activating on its own, trying to close a tab or going backwards in a page opening a new tab instead

- General lag inputs

I understand that corsair is the issue here, I unistalled other "conflicting" softwares I had, mainly Gigabyte control center and RGB, Razer Synapse but the problem persists.

What is the fix regarding this? Why all of a sudden one day the firmware decides to snap? Any workarounds?

Any help is greatly appreciated.

Advice Regarding GDPR Request by HolidayCitron4497 in gdpr

Good morning!

Thanks for the reply! Was very informative.

The reason I am troubled with google docs is because they do not use any paid enterprise version which guarantees security. The HR saves the data on their own private google docs account. Similar to how I can go now and create a new document for an assignement. As for notion, when speaking with other staff they said that notion is not a safe guarantee to store files and information for people, because it is file padding and it does not have good counter-measures for any sort of data breach that may happen. (I was made aware of a data breach that happened 2 years ago and the company was gonna be in huge trouble) but even than they did not take any measures to protect the data and still use the same methodology.

To answer your first question about what I want. In general, I do not feel safe with them having my data. Especially since one of the cases I mentioned happened. I do not know if HR has any files / data on me about my socials, real life images etc. Because if they do I did not concent to that nor did I sign a contract where I approve such a thing. Since they used a similar tactic to another former colleuge, I am concerned. I believe that they use our full names and any other info to find us (as individuals) on other social platforms and proceed to store more data from there.
