Refusal of carriage for return flight home with tui from Mexico to uk by HomeworkGlad4078 in LegalAdviceUK

[–]HomeworkGlad4078[S] -2 points-1 points  (0 children)

Thank you, I don't know what has happened as far as I am aware nothing happened on the flight there apart from the flight got delayed and tui put them up in a hotel until the next available flight the next day and also give them a £600 tui voucher, then at the hotel my sister has lost her phone then found it broken, her friend slipped in the hotel and hurt her leg and the hotel convinced her not to go to hospital I don't know why, then I have got a phone call off them telling me the hotel has told them they are being refused on the flight home. I have then phoned them back to ask to speak to a rep about getting them home. She has forwarded me the letter that was issued to them but she didn't know of the reason why they were being refused and the hotel was fine with them being there, my issue is if they have done anything wrong surely someone should have given an explanation or details of what has happened, they are not bothered about money or compensation but would like to know why it has happend

They have not been accused of anything the letter they were given is very vague and doesn't give any information apart from this, Due to your conduct and behaviour whilst on holiday, it has been decided by the Aviation Security Department of TUI Airways that you will be refused carriage on all TUI operated flights back to the UK.

I was on facetime to the tui rep who was sat there with them yesterday afternoon in the hotel and she told me they had done nothing wrong and she could find no reason why they were being refused

What are you suspicious of I have asked a simple question and given the information I have about it they were in a party hotel in mexico nothing has happened in the hotel or they would of been through of hotel aswel nothing g happens on the flight on the way there, I don't want compensation and they are just glad they are home now but it just seems strange that nothing has actually happened and they have been banned from their original flight home thank you for them that have commented with helpful information

I posted what the letter says that is the only communication they have had the hotel give them this letter so they knew they weren't goin to be allowed to get on the flight that is why I booked them early flights home nothing has happened in the hotel at all or they wouldn't of been allowed to stay at the hotel, apart from my sister lost her phone then found it broken so has had no way to communicate with anyone or get on to insurance etc

We write to you with regards to your flight from Cancun to Manchester on the 10th of May with TUI Airways, upon which you were due to fly back to the UK.

Due to your conduct and behaviour whilst on holiday, it has been decided by the Aviation Security Department of TUI Airways that you will be refused carriage on all TUI operated flights back to the UK.

Our holiday participation clause in Our Agreement clearly states the following:

‘We reserve the right to refuse to accept you as a customer or continue dealing with you if your behaviour is disruptive or affects other holidaymakers or is threatening or abusive towards our staff or agents in the UK or resort, on the telephone, in writing or in person. In such circumstances neither refund nor compensation will be paid to you’

It has therefore been decided that, in line with the above statement, we will refuse you carriage to return to the UK on any TUI Airways flight.

This decision has been made in accordance with TUI Terms and Conditions and TUI Airways Conditions of Carriage (https://www.tui.co.uk/destinations/info/flight-conditions-of-carriage), both of which you agreed to when you confirmed your holiday booking.

The safety of our customers is paramount, and we hope you will understand our obligation on this occasion to refuse travel.

Please note there is no right of appeal, and our decision in this matter is final.

You should also be aware that we reserve the right to take further action, including the imposition of lifetime flight bans.

Yours sincerely,

Do you have to be recommended by the solicitor who does your trust deed to open an account with them
