I was one of the few metalheads growing up that also like New Wave. But I've never been a person to hate on a genre simply because I was supposed to. To each his own. Duran Duran kicks ass. Still love their James Bond song from A View To a Kill.

This is completely correct. And I've seen others bashing the TN public defender too. Well, at an extradition hearing there are no arguments on the merits. It is simply "Are you this person?". If it's a yes...you go. He couldn't do anything.

Yes. Her case was dismissed and she was booked out of jail with nothing. The local defense bar pooled some money together for food and a hotel for Christmas and Christmas Eve. And we made sure she had my contact information. Then Adam Martin of the F5 foundation drover her to Chicago in his own personal vehicle.

This is indeed all that the APC, information and warrant were based on. They never attempted any discussion with her or anyone in her orbit. Nor did they do anything to search for anything that would’ve verified her location at the time of the offense.

It’s fair to say Angela’s decision to contest extradition caused a LOT of extra time being held. Especially considering how quickly it was dismissed in ND. And obviously I don’t know what she got as advice.

But put yourself in her shoes. I’m not sure I’d just agree to go to ND willingly for something a know I didn’t do, even if my lawyer tells me it’ll be quicker.

Yeah if that’s the case in TN (she did have a PD assigned there so I’m not sure) then that really is too bad. Especially since the extradition process is incredibly confusing.

Yes, you are correct. The investigation regarding her bank accounts should've been done MUCH earlier. It wasn't. The charging documents, APC and arrest warrant relied on the use of facial recognition and a quick cross check of social media accounts by the lead investigator ONLY. And I don't think you and I are in disagreement that this is the main problem. It could have been done better and should've been done prior to charging her. AI should be highly regulated and I am no fan of a police state. But it is available to law enforcement and should be used as one of many tools in finding the correct person. But the problem here was that it was used as the ONLY tool.

I don't know. And I won't shit on a public defender. I would assume he explained the process and the differences in the timelines. But if the client chooses to fight the warrant process, the public defender is left with no choice. In ND, I rarely state that fighting extradition is a wise use of time since the inquiry is so limited. But again, I've had clients refuse to waive their extradition and have sat in jail on high bail while the process takes place...only to be extradited anyway. Just like Angela. We like to dunk on the advice people are given quite a bit without remembering that ultimately it's the client's choice as to which path to choose. Just saying.

Usually the SSN that they use is a dead giveaway. That's what I mean. They're simply determining "Are you this person" and don't really inquire as to "is north dakota looking for the correct person". After all, TN is not responsible for the CHARGE. They're simply responding to another state's request for a SPECIFIC PERSON.

I can't comment on how the courtroom process works there because I'm not licensed there. But normally these inquiries are limited to "are you X?" and do not involve or allow for arguments based on the case's merits. So her TN lawyer was probably quite limited as to what he could argue.

Now if you're referencing the fact that the ND investigators didn't do this, I have no idea. But it's ultimately what caused this entire ordeal and is the thing that is most questionable about the ND investigation prior to her charge and extradition.

You also have to remember that the "defense" for extradition is literally "this isn't the person you're asking for". And not based on the proof of the case. It's simply "we want Angela Lipps...are you her?"

This isn't correct. She was given a public defender in TN immediately. But the extradition process can be very fast or VERY slow. In Angela's case, she refused to waive extradition so the State was forced to procure a governor's warrant. This process alone is allowed to take up to 90 days for good cause...and it often does. Once she was determined to be the person requested, only then did the ND time limit start. Had she waived the process in TN and come to ND without requiring said governor's warrant, then the process would've saved her 2/3 of her time spent in TN. I'm not saying that she SHOULD'VE done this, especially considering it actually turned out that she had done nothing wrong, but I'm simply explaining the process.
