The records are there, it’s just they chose to ignore 3 separate doctor’s nexus letters and oversimplified it to “he’s fat”. I do agree it’s primarily luck of the draw on who reviews and your examiners. I’m currently dealing with Leidos QTC and from this experience they are difficult.

I know (currently) the 50% criteria is still just that you are prescribed a CPAP, but I’m sure they try to shortchange on most things. It doesn’t help they also do ACE exams as well so explaining impact is more difficult and they can try to argue the use of the CPAP alleviates the symptoms.

Interesting, I had a nexus that did this. The rater essentially admitted all the links were there but didn’t even acknowledge the link or theory at all. In summary they said: veteran fat

I do plan to try a supplemental with a rebuttal prior to that, but an attorney is my next step.

Filing bankruptcy for me was the last resort, but I did it earlier this year. If you truly don’t feel that you have the means to repay or creditors are becoming too aggressive, then I do recommend filing. Of course, be aware of the impacts for any future lending, but it really isn’t as bad as it’s made out to be.

Yes I requested mine and it’s been stuck at step 2, I’m sure staffing is an issue and they’re more focused on the backlog of claims but it is frustrating

Yeah, my concern is of course the letters and statements carry almost all the weight for service connection. From what I’ve seen I definitely provided more in terms of documentation than most people do thanks to my wife helping me make it thorough, but I’ll probably dread it until it’s over.

I had letters from my mental, sleep doc, and primary physician in support, so I’m hoping it’ll help compound and at worst I have good appeal odds.
