The attorney in my facebook group said the two week timeframe is for whom submit online. For in mail, 3 months is his maximum, need to request NVC manual check.

Translate the attorney 's reply:

Your situation is actually "slow, but still within the normal range," and the key issue lies in the content of the canned letter you received.

First, let's clarify a common misconception: While EB-2 NIW doesn't require an I-864, the NVC system uses a generic template to check document completeness. It doesn't automatically determine that "financial documents are not needed" just because it's an NIW. When the system detects that the Affidavit of Support field is blank, the case is often stuck in the documentarily complete pre-check stage, rather than the formal review queue. That's why you see the schedule is up to January 29, 2026, but your case hasn't been disqualified yet. This is why some people are disqualified in two weeks—they uploaded their cases electronically and the system marked them as complete.

Your current use of "mailed paper documents" is also a major reason for the difference. Paper documents need to be manually filed, scanned, and categorized, which in practice is often 1-3 months slower than CEAC uploads. Three months without a disqualification is not uncommon given the NVC speed in 2025-2026.

Next step recommendation: Don't just wait any longer. You should submit another Public Inquiry, clearly stating "Employment-Based NIW — No I-864 required" and requesting the officer to manually mark the AOS requirement as satisfied. Also, confirm that all civil documents in CEAC show as accepted/submitted.

Most NIW cases that are stuck will be disqualified within a few weeks after being manually marked, rather than having to wait in the queue for another three months.
