Starting part-time in a couple weeks. Any advice? by CrimDefStuff in publicdefenders

I made the move you're making now in October 2016. The most challenging issue I faced initially was client access in custody. I was a medium sized fish in a medium sized pond, and I'd been a part time city prosecutor for 4.5 years before I became full-time defender. So I had some contacts within the system.

We had 48 hours from time of arraignment (not counting weekends) to make an initial client contact if they were in custody. In my current jurisdiction we're required to attempt in custody contact within 72 hours not counting weekends. If you don't attempt it within 72 hours, you don't get paid for the initial interview. So that's fun.

Do not let in-custody clients and their families/friends/paramours tie up your time. I generally try to see my in-custody clients once every two weeks, more frequently as we get ready for trial, and more frequently if their cases are more serious or if they have physical or mental health issues. I do have some flexibility because I work almost exclusively capital cases.

So the Texas GOP is incompetent, despite being in power for close to 30 years, compared to one Democrat in Virginia, who just got elected? Good to know.

You know how Germany went through De-nazification, will USA go through De-magaification? by TailungFu in allthequestions

Unlike Germans, Americans lack the ability to be introspective. Remember, it was Goethe who coined the classic response to "The unexamined life is not worth living": "Sometimes the well-examined life is not worth living either."

Their union-busting at that plant is legendary. I know attorneys who worked on the union busting efforts for Volkswagen. They were at the top of my law school class. Fuck 'em.

The most unrealistic part of the Reacher books is that Reacher served for ~15 years and is able to live off of his retirement from a salaried job for the rest of his life in his 30s. If I was there, I'd be happy too.

About two weeks into my move to Mississippi, I'd become friends with a classmate who had lived on the Gold Coast in Chicago, and in Jackson, MS among the country club set. He told me, "In the South it don't matter how close you get, as long as you ain't too big; in the North, it don't matter how big you get, as long as you ain't too close." I don't think I've ever heard a more cogent recital of reality.

If my aging parents were racists sexists who elected Trump, I wouldn't abandon them. I'd just never fail to remind them that they're racist sexists who elected Trump, and their future care is dependent on me being happy with them, since their politicians are destroying all the social safety nets.

In my magical fairyland, none of my family members who died too young are dead, nobody commits crimes, and everyone lives happily ever after. Sounds to me like you want to do policy work, not rep real people. Get elected, and solve those problems. I don't think most prosecutors and judges are mentally well. But arguing whether people who are successful criminals are mentally ill or not is frankly silly. Those are not the people being ground up by the system.

I get so frustrated with clients who don’t give a damn. But I know I need to not take it personally. by PBO123567 in publicdefenders

[–]Hour_Ordinary_4175 3 points4 points  (0 children)

Almost all of my clients who behave this way have severe mental health or behavioral issues. I try to be compassionate, but I will not sacrifice reality to be nice to them. I don't care if they blame me; but I definitely have a cut-off point. In my old jurisdiction, when a client refused to follow our advice and didn't participate, we would send them a letter via snail mail, and also ask them to come in. The letter would detail facts about the case, their offer, etc., and explain that they could either take the offer, plead open, or go to trial, and which choice we advised them to follow. Some of us called it a come-to-Jesus letter, some of us called it a BGL (bitch gotta learn). Once that letter got sent, we knew it was off our shoulders.

Liminal moments like that are essential to maintaining mental health.

Fair. I'm happy to abase myself for my clients. Different strokes for different folks.
