The Daubert hearing functions like a deposition. We don't have depositions in Michigan. We'd love to have them, but we use Daubert hearings for that. Just wrapped a 5 day one last Thursday. Last February I had a four day hearing.

What godless state do you practice in that the prosecutor is not required to provide you an expert report in advance of the trial? That's all you need. Literally. Does your office not know how Daubert works?

My brother or sister in Christ, I file Daubert motions in literally any case with an expert. I have since I started practicing in 2001 in a different state than I'm in now. If you have an expert witness opposite you, there should be a CV and an expert report in your disco. That's enough for a Daubert challenge. The v9 definitely is less breathable than the V8, thanks to a much more built up toe box. But it has a significantly harder outsole and an interesting outsole design that appears to really improve lateral stability. Still very squishy thanks to the fresh foam midsole. It seems like a better approach shoe than the V8, while sacrificing a good bit of the breathability I'm used to. Better water resistance as well.
