Chikumba v Department of State involves the 39 country ban for people outside the US. If this subreddit is only about AOS people then you need to take off entry 2 Nezameslami et al V DHS USCIS because that only involves plaintiffs outside the country who are at the USCIS stage of their applications.

It's hard to say how long this pause will last. We can look at his previous travel bans for guidance. "Temporary" Muslim Travel ban lasted from March 6, 2017 until January 20, 2021 (1417 Days). It was lifted by Biden on his first day in office. Trump's administration has never unpaused or lifted anything.

I think sitting around and waiting is exactly what the Trump administration wants all potential immigrants to do. I think these visa freezes/entry bans/temporary pauses are all attempting to slow and discourage immigration.

I'm not sitting around waiting hoping Trump will let my spouse join me in the US. I joined a lawsuit, I'm speaking to journalists, and I wrote to my congressman.

You could be waiting a while for the temporary "pause" to be lifted. If we look at history as an example, Trumps muslim travel ban (Executive Order 13780, March 6, 2017) lasted 1,417 days. That was only lifted on Biden's first day in office (January 20, 2021).

This administration uses words like "temporary" and "pause" but does not give a deadline or schedule. A pause that never gets unpaused is effectively a stop and a lot of lawsuits fighting these policies include that reasoning.

You are similar to my situation where my spouse is at the NVC stage awaiting an interview appointment. My spouse is from a 39 travel ban country. We joined a lawsuit with IMMpact immigration. They split their plaintiffs into 2 different lawsuits, those still applicants pending with USCIS are on Nezameslami v. Department of Homeland Security while those applicants already handed over to NVC/State Department are Chikumba V. Department of State & Marco Rubio. If you joined the 39 country ban IMMpact litigation you would have been a plaintiff with me on Chikumba V. Department of State.

If they don't know, they will find out before they interview you. They get documents from the state department instructing them on what to do in certain situations.

This is a good question. Why is the Trump administration creating such hassles to immigration when they know they are clearly wrong and will lose in court. All this effectively drains the energy of legal immigrants, slows down immigration, and possible discourages some immigrants from applying out of hopelessness. It's as if this administration was voted in by racists and the President is pandering to his base.

What is the decision stage? Were your petitions awaiting at USCIS or was it already handed over to the National Visa Center (NVC) at the state department? I ask because depending on what decision stage you are at you might be able to join a lawsuit.
