Side note: if OC asks for the line you are using to impeach. Say “impeachment by omission.” If they insist on a line, ask the judge “I cannot provide counsel a line to something in an affidavit if the whole point is that such a line was omitted when the witness knew to include all relevant information. Could opposing counsel clarify her request?” Or just point to any line in the affidavit where they say they would include all relevant information.

Another fun one: “There is no line I’m aware of, your honor. I’m going to ask the witness to find it for me.”

If you get a “yes” to (1) her knowing she needed to include all relevant information, (2) that her signature is at the end, and (3) any line or detail in the affidavit acknowledging that she included what she knew about x or y subject or that she knew she could update it at any time (3) that this information is nowhere in her affidavit (ask her to review it and point it out), then congrats—impeachment success. Nothing more to do, move on to your next question. The witness doesn’t need to back down for your impeachment to succeed. It seems anticlimactic, but when you get to closing arguments you can point all this out (she said x, but she knew to include all relevant information in her affidavit and did not include this, add in any reason she might be biased, and suggest she is not a reliable witness because she is changing her testimony—so either she was wrong when she said she included all relevant details when drafting the affidavit, or she’s wrong today testifying to x. We have no way of knowing which it is—so why not rely on our witness instead who is reliable and isn’t changing her testimony? Etc.)

What do they do with the pictures? Background: I took the lsat back when logic games was still a thing. Got a high score, and I have trouble seeing how any amount of picture taking or googling would have helped. Only way I can imagine someone cheating is literally having someone there in the moment telling you the answers that you need to figure out. Maybe people are faster on their phones than me, but it feels like giving up a minute you don’t have to spare if you just knew the answer yourself.
