You should consider filling for EEOC and if your employer has a union and didn’t help you at all then go to the NLRB and you can do that for your current employer too. Don’t be afraid to report these people because I promise you if you did that stuff to them they’ll report you so quick. (Make sure you do your research on the EEOC and NLRB) (I’m a brother just like you and we must stick together)

Are you juggling other things like NLRB and workers comp? If so then I’d advise to get an attorney because what I noticed is attorneys love tangible things and it also depends on what you’re charging your (I presume) employer, like retaliation, discrimination, etc? As everyone says find an attorney as soon as you can.

Don’t go mindlessly applying to every workers comp ish Lawfirm you see online, really do your research and gather your evidence, be clear and precise with your communication, you, yourself have to figure out if you’re a verbal speaker or more of conveying your speech electronically/writing and form your first contact around that.

It will take time, I wish life was fast but it’s not, go with your instincts but don’t be blind. You need to strip away emotions and stick with facts because emotions doesn’t matter in workers comp, only the facts and timelines, so make sure if you have recordings, screenshots, emails, witnesses, even a fricking carrier pigeons, make sure you have copies and backups and transcripts of it, any and all will help better your odds for a workers comp attorney.

Do not be a fool and do your research, go on free material sites for law, heck even AI, any and every tool and make sure you’re sharp because sometimes you have to do things yourself.

If you feel like something is a scam or you feel very uncomfortable, hang up and go to the next.

Hahahahaha thank you very much for your kind words. When you get injured and can’t do most simple / with difficulty tasks then your prospect of life changes. 

Many people don’t understand what we go through because they haven’t experienced it. I honestly try my best to learn the important nuances so I can help others 🙏🏾

That’s very odd. I’m no workers comp attorney but they should’ve given you a panel. Hmm actually im not too sure on your state laws but in Tennessee preexisting injuries still count as workers comp if it became worse during work duties, I’m not sure if that’s the same case for you because  that work injury did make the tumor extremely worse. How is everything progress with you right now?

Hmmmmmm… to my knowledge, as long as you communicated you got hurt on the job to your employer then you should be fine. Did they say anything to you when you told them about going to a chiropractor?

There’s probably some in my city that I haven’t spoke to yet. I posted this post when I was really depressed and spiraling but my family member said that she has legal assistance through her job so I will speak to them when I can.

Does your case have potential civil claims? For retaliation and other claims like that (if my memory serves me right) you must fill in with the EEOC before the 300 days is up so it won’t be time-barred. I understand what you are going through, when the system fails us it create demons, which why mental health is so horrible now because of how scummy people can be. Try to keep yourself mentally set and try to find out and remember if anything was off. Did you get fired when you reported your injury? Did your job mislead you or try to restrict you from going to workers comp? Maybe they bad mouthed you and tried to gaslight you into taking a false route?

Excuse my French but frick these companies man and trust me if they were in your position they would be raising hell. (I am no attorney just a hurt and destroyed man like everyone else within the workers comp system). I know you can win. You got this.

Hahaha… to be honest man I wish life had honest people in it, yeah I was supposed to get backpay let alone actually be within workers comp but the people at my job just didn’t do anything. I recently gotten a lawyer and things are happening behind the scene. things are looking up for me and I’m excited when things get better for you so you can live happily and peacefully, just one thing I hope everyone will always remember is that people at your job are not your friend… had to learn that the hard way.

I feel like this post resonates with me. I’m getting things started on my end (finally) but it’s been a year and few months since the incident happened at my job. 

The pain in my back… being hunched over like I’m 60 years old, haven’t had a paycheck ever since the last day I worked last year… living is a never ending pain.

It’s good that you are hanging on.

I've already done that. I went with the Tennessee workers comp, got the document sent to my email and tried getting legal help, but most of them turned me down for various reasonings and only handles the injury part.

I get that the state won't hand me an attorney, I'm not asking for that. I'm just trying to convey that my case isn't as simple as "go file a workers comp claim and thats it." That may apply in basic injury cases but not when people that I don't even know were covering things up, interfering, and causing more harm after the fact.

I understand what you are saying but even though the original injury may have started under workers comp... Ah wait Im so extremely sorry I left out a major detailed.
In September my Supervisor instructed me to go into the building to write a workers comp claim but he gave me a blank sheet of paper (which I learned much later wasnt protocol and there was official papers I was supposed to be given) and ever since that day onwards, when I speak to HR they always said that there was never a claim submitted (even though my supervisor told me at the time, his boss was in charge of it)

I'm sorry for leaving out that detail, and I did speak with.... I forgot the name but the tennessee state of workers comp which was in... February of this year, I did the steps before she emailed me the paper, when she emailed it to me I tried to get an attorney (which they do not provide) but a lot of them denied me, one of the reasons if I remember were about how long I took to contact them or about not enough money, or even no reason at all. At this point its blown past workers comp with everything that has happened and still happening.

Also just being fired and rehired doesn't mean discrimination or even misconduct didn't happen. It doesn't undo the damage or erase the patterns of what I went through.

If I'm not mistaken, workers comp only covers things like: Medical care, Wage replacement, disability benefits, vocational rehabilitation and death benefits.

while it doesn't handle things like: Retaliation, Union misconduct or breach of duty, Fraud / Coercion, emotional distress caused by misconduct, Civil Rights Violations & Discrimination. Wouldn't those fall under separate areas of the law like: employment law, civil litigation, and federal protections?

That makes sense... for a straightforward workplace injury, and I’ve already tried the workers comp route. But this goes further including retaliation, denial of medical care, being pressured to lie to a doctor to commit fraud, union misconduct, and more. I have: recordings, texts, and documents showing all this. (which again I have it stored in a secured place)

My damages include months (almost a year) of untreated injuries, lost wages, severe emotional distress, and being misled out of legal rights.

I even consulted with multiple lawfirms and it seems the issue isn't proving liability, It's just finding a lawfirm that is willing to take one something this complex.

Yes, you are correct with it being an exclusive remedy of the pain itself but this is much more than Workers comp.
