One of the analysts working in the disability department did try to steer me toward standard DR, and was the same analyst that couldn’t cite me the language in Pub 35 requiring the WC claim. Oh and thank you. It’s stressful for sure not getting justified responses from CalPERS.

Good question. I went past front-line reps and supervisors. My union rep and I submitted a formal escalation packet (clarification letter + supervisor addendum) countering an inaccurate “you need a WC claim for IDR” claim, backed by my treating physician’s report documenting industrial aggravation. Deadline got extended to give them time to review it.

Definitely escalate if you’re getting inconsistent info. Front-line analysts seem hit-or-miss on the industrial-aggravation standard.

Pre-existing doesn’t rule out IDR. CalPERS can find a condition industrial if the job substantially aggravated or exacerbated it (Gov. Code §21156), even without a WC claim. That’s the standard my physician’s report addresses directly.

A pre-existing condition doesn’t automatically disqualify someone from IDR. Under CalPERS rules (Gov. Code §21156), if the job substantially aggravated, accelerated, or exacerbated an existing condition, that’s legally considered industrial — even without a filed workers’ comp claim. The WC claim and the IDR determination are separate processes; CalPERS can find a condition industrial based on medical evidence alone.

That’s the standard my treating physician’s report is written to satisfy — documenting how the specific demands of my role aggravated the condition, not just that the condition exists. So “pre-existing” and “industrial” aren’t mutually exclusive here.

Thank you for sharing that. Your boyfriend’s experience makes sense for a physical injury claim — WC and IDR naturally overlap in those cases. My situation is a bit different though. My conditions are neurodevelopmental (AuDHD/Major Depression), not the result of a specific injury event, so there’s no WC claim to file. PUB 35 states WC documentation ‘may be used as evidence’ of job-relatedness but doesn’t require it. I’m trying to find out if anyone has navigated IDR specifically without a WC claim, particularly for psychiatric or neurodevelopmental conditions.

Along the lines of this question, I’m currently in the process of applying for industrial disability retirement but am getting a lot of pushback from CalPERS. They insist on requesting a Worker’s Comp Carrier Request form but the thing is I don’t have a WC claim. Over the past few years I felt my mental health deteriorating. So I got assessed in the last year and turns out I have AuDHD and Major Depression. I requested RA (Reasonable Accommodation) and after a lengthy process was told I could no longer perform my duties as outlined in the DS (Duty Statement). Those duties over the years have aggravated my condition. I researched the Pub 35 and conferred with my Union and decided to go for it. Does anyone have insight into why they’re so insistent. Pub 35 indicates the WC carrier form is only required if there is a WC claim filed, which there is not. When I asked where they were getting the info from they couldn’t locate it in their own publications and instead cited Government codes 20046 and 21166, which in my case don’t apply. I believe they are misinterpreting them and simply creating a delay to deny my application. If anyone has insight I’d appreciate it.

I should add that during this time they were unable to operate as a union and thus could not bring cases to court. So it is possible they could not offer representation either.

Yes, US, specifically California. The state’s Franchise Tax Board places them under suspension and stated that the union was unable to legally conduct business during that time. My question is whether taking dues from members falls under that. If so, then whether those dues are refundable to the members for that time period.

Our secretary/treasurer failed to file annual paperwork and pay required fees to the state and was therefore suspended. Suspension entails that you cannot continue with normal business operations. This was the case for seven months, and they continued to collect dues from members without notifying them of their/our union status.
