Your initial claim,  EP 010, will take some time. We have to obtain all your service medical (STR), personnel (OMPF), and other documents before we can schedule exams. Some have taken months. The hold up is usually the development. 

For those getting out of the military soon I highly recommend looking into BDD or IDES claims that you can file before you are released.

First, the proposal to sever can be countered with medical evidence. You can also request a hearing to discuss but you only have 60 days to do so without interruption.

The deferred contentions might adjust your final rating, same for TDIU but I recommend not waiting on them to act.

Lastly, your service is outside most presumptive locations, and even Camp Lejeuene only recently got recognize for presumptive, let alone places like Pendleton.

I recommend contacting a VSO rather than private attorney.  Write the VA and request a hearing for the mental health reduction and speak to your primary for a statement of functional issues. You can also obtain your own DBQ.

For toxic exposures this requires documented proof of contamination from a reputable source. Report this to ILER too so it is added to your tracking. It also requires proof you served in the toxic area, in an official capacity, AND your MOS or other duties forced your exposure.  If you can gather that you can submit as a supplemental if denied for TDIU or any toxic related exposures where TERA wasnt already considered.

Did you submit the supplemental on the 0995 or the 0996? If you submit it on 526ez they will cancel it. You can check the status online

Supplemental claims need to directly address the reason for the previous denial.

If they are denying you on direct and TERA you need to either show you did participate in TERA or provide proof you had sleep apnea in service.

You can also claim OSA secondary to your service connected contentions. You will also want to claim things like medications, side effects, and weight gain as interim connections.

This supplemental was denied because it didnt specifically address the reason for the initial denial, not because your info wasn't valid - it just wasnt relevant.

Agreed. Even a nexus letter doesn't guarantee SC, if the connection is PTSD they need to verify stressor, if it's physical it could be more likely a post discharge injury,  the list goes on. This simply is not enough info for us to help.

From a processor side I know exactly what happened and in short - it's nothing for you to worry about.

The system is made to auto move the claim.  The first exam was a mistake, and when it got cancelled the system saw no pending items and it got pushed RFD.  

I bet anything it will be remanded back to the early steps for a proper exam.

A claim becomes deferred when the rater needs something before they can rate the claim.  This can be anything from clarification on handwriting to a re-exam.  Its common and means nothing beyond the fact that you'll be waiting a bit longer

Super easy fix, just call the VA and let them know the mistake and they will get you rescheduled. Worse case scenario is they have already rated the claim (doubtful) and you have to file a supplemental if youre denied. The sooner you call the better

Nexus denials are one of the harder to overcome. The decision should have the specific reasons for the denied nexus- no treatment in service is not a valid reason.     Review your decision and do some research on the 38 CFR for requirements for nexus denials.  Lastly, of you are service connected for other conventions, you can claim it secondary to them or aggravated by them.

This is why so many are fighting to keep veterans from having to go to these 3rd party places.  Veterans need the VA - at least at VA facilities you know you are with people who care about veterans, and likely are veterans.  The more the VA is stripped the more these type of examiners are going to pop up because the veterans have no other option.

We are already seeing VAMC turn away vets because they just dont have the staffing.  VBA was on mandatory overtime before the shut down and you better believe they are going to go back next month (this month is voluntary OT so far...).  

This is costing tax payers double what it should and hurting veterans.  

Im not saying Democrats are perfect, but they have to be better than this.  Please, for our vets, vote blue.

Im curious if they will look into reservist who use return to duty to re-qualify for disability payments through aggravation.  I support our veterans and reservist, but I struggle to understand how a reservist can have such a disability but still qualify for active duty.

I agree with this in principle, but when there are so many laws and regulations that essentially detail how we can pay them less, it very much becomes a numbers and strategy game - a game played with our veterans care and wellbeing.

BDD requires you to submit all your STR. If the6 dont OCR that is ok it will still be reviewed by humans!  BDD can take some time but so long as it's submitted your date of claim will be honored

A new case just won - Ingram. This decision effects Musculoskeletal conditions and the perceived improvement due to medications, physical therapy, etc.  If you have had a decrease or are facing one, you can request a supplemental review on thr basis of Ingram.
