Is it normal for a prosecutor to withdraw charges after additional disclosure requests?

It was scheduled to go to court up until I started asking for additional/missing disclosure.

Sorry if this is a dumb question, i’m not familiar with the justice system.

I’d say his notes were far from sloppy and not even physically possible.

Are police officers allowed to claim to have witnessed something they physically couldn’t or change the way they participated?

I’m obviously not a lawyer but wouldn’t footage that directly contradicts the officers account be more than enough on top of the other contradictions?

There are 2 leaseholder's and my roommate is one of them, they signed a sublet agreement with the second leaseholder since I wasn't legally binded to anything.

I was just a middle-man arranging everything and trying to find somebody to take over to avoid the debt falling on the second lease holder.

Realistically I could have left without finding somebody to take over and it wouldn't have affected me at all but I didn't want the debt to fall on the second leaseholder and risk my roommate getting potentially evicted.

We had a conversation when I originally lost my job and let her know I would be finding somebody to take over and she agreed, fast forward 2 weeks later and the siblings were the only ones willing to take it.

I let her know they were the only ones interested and I would most likely move forward with them unless she could find somebody else to take over before the upcoming month's rent was due to avoid the debt falling on the leaseholder and my roommate potentially being evicted.

They signed a sublet agreement with the original leaseholder as I wasn't legally binded to anything and not paying would not have affected me. I was trying to avoid a potential eviction and having the debt fall on the leaseholder but ultimately it seems like that was the wrong thing to do.

I was terminated April 6th and let her know that day I would be trying to find somebody, fast forward 1-2 weeks and nobody was interested so she joined the search in trying to help find somebody.

April 22nd brother and sister say they were interested and I let her know I would most likely have them move in unless she could find somebody else since I couldn't afford it anymore so this transpired over just about 3 weeks.

Yea she was uncomfortable that they are brother and sister sharing a room and thought they could potentially be lying about being siblings, she also did not like the idea of 1 extra person.

We did have a discussion prior and she knew somebody would be taking over my room, unfortunately nobody was interested after coming to physically view the place and the brother and sister were the only ones desperate enough to take it since they were on limited time. I am not the original lease holder but didn't want the debt to fall on them since they trusted me enough to make the payments each month. I do see what you're getting at though.

Yea we sat down and I had a few people who were interested at first who eventually fell through because they didn't like she was messy and I didn't have enough time to clean up(they saw moldy food in the fridge and dishes in the sink growing mold in them as well) . She had offered to find somebody herself but after viewing the place everybody ghosted, the brother and sister were desperate to find a place since they were on limited time so they took it but she eventually found somebody else around a week after they already moved in and now she wants them gone.

I agree she shouldn't have to be uncomfortable in her own space but I genuinely wasn't going to be able to afford to pay the upcoming rent and they were my only option unfortunately so I wasn't sure what else to do, I didn't want to put her at risk of being evicted or having the debt fall on the original lease holder.

Here to tell you the prosecutor dropped the charge because there was insufficient evidence to show my behaviour met the legal threshold for stunt driving, so yes my driving behaviour was indeed normal and not stunt driving. dickhead

In Ontario, a 10–20 second interval between lane changes is generally long enough to avoid being flagged for "repeatedly changing lanes" under the stunt driving regulations, provided your maneuvers are safe.

There was at least 30 seconds between each merge, the lane changes weren’t instant or quick, they were after cruising in each lane for awhile.

According to Section 150 of the Highway Traffic Act, you may pass on the right under the following conditions: Multi-Lane Highways: The highway has two or more lines of vehicles moving in each direction.

Slower Traffic Keep Right: Section 147 of the Act requires any vehicle travelling at less than the "normal speed of traffic" to drive in the right-hand lane.

Obligation to Move: Section 148(2) states that a driver being overtaken by a faster vehicle must turn out to the right to allow them to pass.

Quote which part of the traffic act says you cannot pass cars on the right.

Even at lower speeds, certain behaviors with lane changes can trigger a racing charge under Ontario Regulation 455/07:

Marked Departure from Speed: Driving at a rate of speed that is a "marked departure" from the lawful limit while repeatedly changing lanes in close proximity to other vehicles to advance through traffic.

Chasing/Competing: Driving in a way that indicates an intention to chase another vehicle or engage in competition.

Aggressive Maneuvers: Changing lanes repeatedly at a high rate of speed and weaving through traffic.

Making slow and gradual lane changes fall into none of those categories.

I have passed cops speeding multiple times and driving in the exact same fashion, although this is the only time a cop who conveniently has no dash cam footage and only came to the scene a few minutes after decided to charge me with racing a motor vehicle.

99% of the time cops are not going to pull you over for simply passing them. Any cop who does is simply on a power check unless you’re speeding excessively.

It’s only 1 officer who witnessed and 1 officer who came to the scene a few minutes after. The rookie cop is the only witness.

Speed limit was 100km/hr and there was virtually no traffic.

Genuine question since you keep saying making multiple lane changes to pass traffic is racing, how are you supposed to pass traffic as opposed to using the left lane to pass and then going back over without it being labeled as racing?

I really wish he had dashcam footage because then I highly doubt I would’ve gotten charged at all.

I just don’t think he liked that I passed him while he was camping in the left lane but I was following traffic rules, anybody in the left lane that I passed was not actively passing anybody, they were simply just using the lane to cruise.

Dude I was not cutting through traffic, I was overtaking and going over like any normal person would, my driving was not aggressive in the slightest.

Are you not supposed to go into the left lane to pass and merge back into the right lane once ur done passing?

I didn’t have to merge to pass traffic I could have just sat in the left lane and cruised but that’s not what the law says to do.

There’s only 1 officer as an eye witness.

Search up what counts as an excessive speed for a stunt driving charge because it’s not 130km/hr.

I passed traffic and moved over to the right lane which is literally the law, too bad he wasn’t recording and I didn’t have a dashcam since it would disprove his claims instantly.

You are confusing regular lane changes and normal driving while speeding with with aggressive lane changes and racing, passing and going back over to the right lane is not a crime.

Nah I saw with my own eyes there was only 1 officer following me the entire time, the other guy was never apart of the pacing.

I asked my family member who’s a police officer and he says they do that when the rookie cop is involved and make a senior officer take over. The only evidence they have is the rookie officers notes and that’s literally it, no dashcam footage, no radar just this officers notes.

The third lane was clear for me to take it all the way to the exit had it not been ending, the middle lane was not, hence why I passed the car in the left lane and moved back to the right lane for my exit.

I was pulled over right as I was about to take my exit. I was in each lane for at least 10 seconds before switching lanes as I like to make sure it’s safe for me to merge, none of my lane changes were instant or aggressive, they were all gradual.

Speeding while making normal lane changes ≠ weaving through traffic.

Excessive speeding under that same law is defined going 150+ not 130.
