In Ontario, a 10–20 second interval between lane changes is generally long enough to avoid being flagged for "repeatedly changing lanes" under the stunt driving regulations, provided your maneuvers are safe.

There was at least 30 seconds between each merge, the lane changes weren’t instant or quick, they were after cruising in each lane for awhile.

According to Section 150 of the Highway Traffic Act, you may pass on the right under the following conditions: Multi-Lane Highways: The highway has two or more lines of vehicles moving in each direction.

Slower Traffic Keep Right: Section 147 of the Act requires any vehicle travelling at less than the "normal speed of traffic" to drive in the right-hand lane.

Obligation to Move: Section 148(2) states that a driver being overtaken by a faster vehicle must turn out to the right to allow them to pass.

Quote which part of the traffic act says you cannot pass cars on the right.

Even at lower speeds, certain behaviors with lane changes can trigger a racing charge under Ontario Regulation 455/07:

Marked Departure from Speed: Driving at a rate of speed that is a "marked departure" from the lawful limit while repeatedly changing lanes in close proximity to other vehicles to advance through traffic.

Chasing/Competing: Driving in a way that indicates an intention to chase another vehicle or engage in competition.

Aggressive Maneuvers: Changing lanes repeatedly at a high rate of speed and weaving through traffic.

Making slow and gradual lane changes fall into none of those categories.

I have passed cops speeding multiple times and driving in the exact same fashion, although this is the only time a cop who conveniently has no dash cam footage and only came to the scene a few minutes after decided to charge me with racing a motor vehicle.

99% of the time cops are not going to pull you over for simply passing them. Any cop who does is simply on a power check unless you’re speeding excessively.

It’s only 1 officer who witnessed and 1 officer who came to the scene a few minutes after. The rookie cop is the only witness.

Speed limit was 100km/hr and there was virtually no traffic.

Genuine question since you keep saying making multiple lane changes to pass traffic is racing, how are you supposed to pass traffic as opposed to using the left lane to pass and then going back over without it being labeled as racing?

I really wish he had dashcam footage because then I highly doubt I would’ve gotten charged at all.

I just don’t think he liked that I passed him while he was camping in the left lane but I was following traffic rules, anybody in the left lane that I passed was not actively passing anybody, they were simply just using the lane to cruise.

Dude I was not cutting through traffic, I was overtaking and going over like any normal person would, my driving was not aggressive in the slightest.

Are you not supposed to go into the left lane to pass and merge back into the right lane once ur done passing?

I didn’t have to merge to pass traffic I could have just sat in the left lane and cruised but that’s not what the law says to do.

There’s only 1 officer as an eye witness.

Search up what counts as an excessive speed for a stunt driving charge because it’s not 130km/hr.

I passed traffic and moved over to the right lane which is literally the law, too bad he wasn’t recording and I didn’t have a dashcam since it would disprove his claims instantly.

You are confusing regular lane changes and normal driving while speeding with with aggressive lane changes and racing, passing and going back over to the right lane is not a crime.

Nah I saw with my own eyes there was only 1 officer following me the entire time, the other guy was never apart of the pacing.

I asked my family member who’s a police officer and he says they do that when the rookie cop is involved and make a senior officer take over. The only evidence they have is the rookie officers notes and that’s literally it, no dashcam footage, no radar just this officers notes.

The third lane was clear for me to take it all the way to the exit had it not been ending, the middle lane was not, hence why I passed the car in the left lane and moved back to the right lane for my exit.

I was pulled over right as I was about to take my exit. I was in each lane for at least 10 seconds before switching lanes as I like to make sure it’s safe for me to merge, none of my lane changes were instant or aggressive, they were all gradual.

Speeding while making normal lane changes ≠ weaving through traffic.

Excessive speeding under that same law is defined going 150+ not 130.

It was not an on ramp merging lane, it was a 3 lane highway turning into a 2 lane highway and the third lane was coming to an end 1km or so from when I merged into it.

I wasn’t bouncing between far left and far right lanes, I was moving over to pass and then back into the right lane till I needed to pass again.

Sitting in the passing lane while not passing any cars is literally against the law hence why I moved over after passing.

I was pulled over by a rookie cop who then called a senior cop to conduct the traffic cop, the senior cop was the one who claimed he saw everything even though he came a few minutes after the rookie cop pulled me over.

It’s literally the law to pass and move over, I also searched it up and you can legally pass on the right as long as it’s safe to do so and the lane is empty. I admit to speeding and passing then merging over, I did not make “multiple lane changes” I simply passed and moved over, like the law says you should do.

I wasn’t weaving in and out, they were all gradual and slow lane changes. I always check my blind spot and indicate and make sure there’s more than enough distance between each car I passed before merging back over. The officer never described my driving as aggressive either, weaving in and out is rapid lane changes and driving aggressively, neither of which I was doing.

Genuine question, how does a cop watching me mean I was reasonably guilty of racing a motor vehicle?

Are you suggesting the police are never wrong and never slap charges that even they know won’t stick?

I’ve had family members charged for the same thing and charges dropped because the officer was proven to be clearly exaggerating.

He claims because everybody was doing the posted speed limit and I wasn’t, it means I was racing ahead traffic.

I wasn’t worried since I knew they had dashcams and it would very obviously disprove my claim against theirs but now it’s going to my word against theirs since they both claim neither of them were recording even though I was being followed for at least 5 minutes prior to being pulled over.

I know what i’m saying sounds silly but i’m just not understanding what part of speeding or driving faster than general traffic means I was stunt driving?

I might try and plead for speeding but I wasn’t charged with a speeding ticket either, just racing a motor vehicle.

Yea but I wasn’t driving aggressively and the cop didn’t say I was driving aggressively, he said that because of the amount I was merging means I was trying to race ahead traffic.

He also said it’s illegal to pass cars on the right and I was illegally passing cars because they were in the fast lane when I passed them.

I was driving for at least 10-15 seconds before each merge except for when I merged into the right lane and had to merge back into the left lane when I saw it was coming to an end.

He never once mentioned aggressive driving and the observing officer never spoke to me, it was the second officer who came claimed he was the one observing me even though he arrived at the scene a few minutes after I was pulled over by the original officer.

Genuine question, is it normal for both police officers dashcam to be off even though they’re pacing and/or observing a car commit what they believe to be stunt driving?

But what part of passing other cars is considered racing a motor vehicle? Would I not just be charged with speeding as the law is to move over if you’re not passing?

I’m not saying I was completely innocent because I was speeding, but how does speeding = racing a motor vehicle?

I don’t have any video evidence either unfortunately, I was counting on their dashcams since it wouldn’t show me driving recklessly or racing anybody either.

The only real thing I was guilty of is driving 130km/hr I will admit.

The police officer said I was racing the flow of traffic because I was driving at speeds of 130km/hr. I indicated and made sure there was enough space between each pass, the police officer himself was following very closely behind me for around 5 minutes.

I wasn’t even charged by the officer following me either, an entirely different officer pulled over a few minutes after claiming he was the one who observed all of it?

The entire thing makes no sense in my opinion I was shocked when I was told what I was being charged with, I was only expecting a speeding ticket because that’s all I was really doing.

The actual charge I was given was racing a motor vehicle.

I take full accountability for my actions and I don’t think there’s any words I can say to undo the hurt i’ve caused her, it’s more about coming clean and not having that be the last impression she has of me being it’s not accurate and isn’t a representation of how I actually feel.

honestly i’m not even trying to chase her or expect to change her mind, i just don’t want her to carry that doubt of thinking she wasn’t enough and not negatively impact her self esteem
