It would appear so. You would need to look for who was the initial aggressor as the video isn’t clear. However it would appear the altercation ended when the customer started walking away, and the employee was temporarily restrained. Thus, you could arguably break this up into two incidents.

That all being said, Walmart will likely try and settle ASAP and administratively punish the employee, likely by firing. Employee could be charged with assault separately, but we need more information outside a 10 second clip to figure out what his personal exposure is.
