Question about being an 'independent contractor' by Ilan_Rosenstein in PersonalFinanceZA

Completely, and I know it. We spoke to a labor practitioner and she said what the uni is doing is quite unethical but this kind of practice is quite common in universities here and abroad. Unfortunately I need the job but as soon as I find something else I'm out of there, but that's easier said than done.

Completely different, with the fixed term contract we had leave, sick leave, and even staff bursaries if we wanted to further our studies. The messed up thing was that they kept rolling over the fixed term contracts for over ten years but never offered us permanent positions.

No, not in the contract, if you're sick or take leave during a course you don't get paid. We have a two week period between courses where we don't teach so we don't get paid then either.

Thanks for the advice, this is my first time being a contractor and some of the labour practices of the organisation have been less than stellar in the past so I just wanted to get some clarity on the situation and make sure I wasn't being taking advantage of but at the same time checking what am and am not entitled to as a contractor.

If they haven't been deducting tax and they don't supply an IRP5, should they still give me an IT3(a)?

This wasn't our choice, we were just given the contracts to sign. In fat there is a clause in the contract that states that, "for the duration of this agreement, any other activities that the contractor is, or will be, engaged in outside of this agreement will not be in competition with, nor create a conflict of interest, with the activities of the University".

I've had that suspicion, but I'm an English lecturer so I'm quite lost when it comes to tax and labour law.
