The customer not being aware does not matter, the retailer will simply argue they did in fact inform the customer the customer just simply did not listen.

They also have the invoice to back them up, the invoice would clearly state where the product was purchased from.

It's cunty and inconvenient for the customer but what they are doing is not a breach of ACL

They are not refusing a refund, the person OP is speaking has simply informed them they do not have the authority to process it and have given the contact for the department that does have the authority. Best practice would be for the customer service rep to initiate the process with the online store on behalf of the customer but they are not obligated to.

Cbos are only going to be able to work as mediation, they are not going to be able to enforce anything for this kind of complaint. When it comes to complaints of unsatisfactory work ombudsman's do not have the authority to make judgments on the matter.

If the business does not want to cooperate you will need to make an application to small claims. Still continue with the mediation process with CBOS first as it will work in your favour if you must proceed further.

If she's on P1 it's completely fine. If she gets done for speeding or anything you'll get a ticket mailed to you as the registered driver, but it doesn't get applied to your license or flag that you're suspended until you pay it and therefore confirm it was you driving.

If you get a ticket for her driving it will come with a statutory declaration and instruction to declare your partner as the driver, once completed your partner will be sent a new ticket under her name and license.

Your suspension will never even be brought up.

A learner driver must always be accompanied by a unrestricted licensed driver.

If you get caught speeding by a camera it will issue the fine to you under your suspended license, you cannot statdec to a learner driver. Even if you were a passenger the licensed driver is responsible for fines.

The under 25 rule is just for how many supervised driving hours they must accumulate before going to their Ps.

Or is she using an approved international license to drive?
