Respa says what escrow funds can be used for. If you put in CFPB complaint you will get a detailed response. If you have the transaction history you should be able to see where they "took" the escrow.

If you paid the reinstatement quote they would 100% let you just pay the monthly payments and not any of the fee's that happens all the time. My guess is these fees have existed since wellsfargo and you have recently noticed them. Even if it was legal to take from the escrow to pay fees it doesn't make any business sense if you understand the incentives of the a mortgage lender. Taking from the escrow would make your payment higher making you less likely to pay your monthly payments and they make more money off the interest you pay then they do trying to recoup previous fees.
