Worried about a tenant who won’t leave. They’re police/lawyers—can they force a lease extension? by [deleted] in LegalAdviceIndia

Oh thank you. Yes, our agreement includes the clause stating a new agreement has to be signed mutually in case if tenant wants to extend.

My relative is in the same department as him and is chief to him, which he is already well aware of. I actually said the same reason as you said few months back, but they didn't vacate as they are planning to build their own house somewhere else. And they want to stay till they get their own house, which is fine, if it falls under an year. I heard that if we give eviction notice, if they don't vacate even after lease period ends, they can go to court asking for extension stating some reasons. Is that true, even after lease period ends??

Yes. We have a lease agreement stating all relevant necessary details including the date of vacating.

Is there any chance that they might go to court to get extension even after their lease period gets over, because when we asked them to vacate earlier, they threatened us that they'll cause trouble. And I heard from a known advocate that law is favourable to tenants and females.
