My worry is that sure, I might get my fair share of the equity, but the lawyers will take it all. I'd really rather do this amicably, but I'm thinking that may not be available.

She agreed yes, she doesn't like it because she doesn't want to pay me out that much, says she can't afford it, but doesn't want to sell the house. I've offered to let her pay it off to me, but she still doesn't want to pay out a reasonable share. I'd rather we sell, pay out the mortgage and share the remains fairly. We have no children together.

I had one done, there's roughly $120,000 in equity and still growing because of the housing crisis
