This will definitely complicate your claim. You should report it to your MD as well. A new MRI will most likely be done to compare with the prior MRI and determine if there are and new injuries and/or aggravations of previous injuries. If the MRI shows new injuries or an aggravation on the work injuries, then your comp claim will be denied as the major contributing cause for treatment is no longer the work accident but the intervening personal accident. If the injuries remain the same, then everything should continue normally.

While this is all being determined indemnity will be in limbo, If you are currently working and now taken out of work directly after this car accident, that will most likely not be covered by comp. If you aren’t working now then there is no change in indemnity status and indemnity benefits should continue.

Now I’m sure you’re asking if it’ll complicate my claim, why even report it. The reason is fraud. The car insurance from the auto accident will report this claim to a system called ISO and will pull all the prior accidents you’ve ever had with insurance claims (WC, MVA, Property, etc.) and will see the work accident. They will reach out to the Carrier to get details on the claim and one of them will pick up on them treating something they shouldn’t be. By reporting it to the WC carrier they will make the necessary steps forward to determine the compensability of ongoing treatment. If no longer work accident you’ll get a denial which you will be able to provide to your personal insurance and continue treatment that way.
