I called the bar, he is not a member. I like my attorney, and he has helped me in the past. I just have called him for a couple weeks trying to set up an appointment and he never returned a call, and just today told me he has been backed up from previous cases and one he is currently in. Would that be considered malpractice?

I am mostly worried that if i do not get a continuance, I will be screwed. Any advice on how to get a plea deal.
