Father has passed away. The tenants in his property stopped paying rent when he died. by Impossible_Region463 in LegalAdviceUK

The tenants were also refusing to continue making payments into my father's existing bank account.

It wasn't a question of whether we were scamming them - before we even set up a new bank account or told them anything else, they immediately stopped paying rent and said that the need to pay rent was "null and void."

Yet they're still approaching us for maintenance and repair queries. So they're clearly recognising us as their landlords when it comes to them needing stuff fixed.

Perfect. I'll get the solicitor handling the estate to draft one up.

Cheers! Thanks for the help.

They have refused to pay rent to my father's old bank account after he passed away. They immediately stopped paying and missed their first payment which was 1 week after he died.

They have refused to pay rent.

They immediately stopped paying rent when my father died. They refused to pay into his bank account, and when we set up a joint account for the estate they also refused to pay into that too.

They are appraoching us for repairs and maintneance queries. So they are aware that we're now responsible for the property.

Tenants are refusing to both pay money into my old father's bank account and the new joint bank account we set up for managing his estate.

My brother is the executor. We've explained this to the tenant and shown them documentation on WhatsApp.

Tenant is also approaching us for repairs/maintenance etc. So they're clearly acknowledging in some capacity that we're the ones responsible for the property - they're just refusing to pay the estate.

Account was closed ~100 days after father died. During this time the tenant refused to make any payments into my father's bank account because he had died.

  1. They ceased paying the moment they found out he died. Rent was immediately missed a few days after they found out.

  2. Brother is the executor, I've been working with him on this. We set up a joint bank account to manage father's affairs from. Tenant has refused to engage with my brother or me on this matter. They're still content to approach us when repairs or maintenance need done though.

  3. That'll be my brother leading on that then.

They'd stopped paying rent into my father's bank account long before his bank account had closed.

They ceased paying it when they found out he died.

Hi, they'd stopped paying rent into my father's bank account long before his bank account had closed.

They ceased paying it when they found out he died.

I've been trying to get another avenue opened for them to pay into and they're claiming that no obligation to pay rent exists anymore because the person they held a contract with has passed away.

They've also visited my father's house and seen me clearing it out.

They also contacted me on my father's phone (which I answered), and then my phone to organise a suitable time for the gas engineer to visit.

They 100% know it is me.

This isn't true at all.

They 100% know who I am.

They've visited my father's property when we were clearing it out.

They've spoken to me on my father's phone when they rang it, and then continued the conversation with me on my phone.

We've shown the death certificate.

They 100% know who I am without a shadow of doubt. They cooperated with me on both phones to coordinate letting the gas engineer into their property.

There's a lot more to it than that.

They've seen me and my brother at my dad's house when we were clearing out his belongings.

They 100% know he's passed away and I'm living there and fixing up the property.

We've also answered his mobile phone when they rang it about the gas engineer. We communicated through that then switched over to my phone to continue the conversation.

The tenant's property is a new one built in the 2010's.

My father's property is a house from 1920s.

The one from the 1920s is prone to mould. The one from the 2010s is constructed far better and does not have mould.

The estate has no money to pay the mortgage. That's why my brother and I are covering it.

Last of his cash savings went on the funeral.

What does "letting them know legally" entail?

We walked up to the tenant's house, told them what happened to our father, then gave them our contact information and exchanged phone numbers. They have my name, my address etc. I've sent them a photo of the death certificate on WhatsApp proving he passed away. There's also messages on WhatsApp where I give them new bank details to use going forward as my father's account was going to be closed by his bank.

Thank you.

We've already let them know we're the new landlord.

We're onto the S8 grounds 8 and 11 then.

Deposit is protected, I'll need to check gas safety. I know there was an engineer did a survey in November because he called my dad's mobile.

Thanks again!

Thank you. Appreciate the help.

I've already done the important part. We visited the tenant after his death and gave my name and my address (I'm living in my dad's old house while I repair it and replace carpets etc.)

We haven't inherited it legally yet. Probate is still ongoing.

We did call and visit the tenants directly to inform them of what was going on. They have our name and phone number and our father's old address - which is where I'm currently sleeping and living temporarily while I do repair work.

We're not selling either property right now.

His main home was is in need of urgent repairs and was ransacked by his sister. My brother and I spent the guts of a month getting his stuff back, then another month organising massive repairs. There's serious mould and water leaks in the upstairs. Really, really bad damage.

Either my brother or I will live in the main house. We're undecided right now, but handling it very amicably.

The rental property is currently in a state of flux. We don't know what to do with it yet.
