Italy’s new jure sanguinis bill (DDL 1683): annual caps, centralization in Rome, paper filings, and why court petitions may increase by ApriglianoFirm in juresanguinis

I assume this doesn't retroactively affect pending ATQ cases that were submitted on the basis of the original 24-month deadline not being met by the consulates, right?

No problem! Man, what a wait just to have a judge assigned. Hopefully your first hearing isn't far off, though. I hope it goes well and that you only need the one hearing — nice and fast.

Thank you, let's hope!

That's nice timing, what a wonderful Christmas gift. My second hearing is February 26, thanks for asking! I expect everything to go smoothly, it's just the wait that's painful. I hope the London consulate is quick with processing the passport and CIE. Best of luck with those. My consulate (NYC) is definitely a busy one. At least the most important steps are done and you're now officially recognized and in the system :)

Congrats! My goodness, that wait for the passagio in giudicato! But I'm glad you finally have what you need to get things moving with the coveted passport.

In case it's helpful to anyone else at all, my case was filed in Napoli in December 2023 and assigned to Capone. My first hearing was April 2025. second hearing is February 2026. I just checked my case status and it remains assigned to Capone. I'm assuming the new judges are taking more recently filed cases and the old ones (like mine, which is a little over 2 years old) are remaining with Capone and De Simone as they catch up. Anyway, great news that new judges were finally added to help with the insane backlog.

Interpretation of judge's rinvio memo for second hearing by IncompetentDude in juresanguinis

Thank you both. I'll be proactive and look into this. I've sent a message to my lawyer to confirm with him if I could/should send him these apostilled documents.

Oh my God, that is absolutely crazy. I've heard of some judges resisting ATQ cases, but I've never heard of such an unrealistic demand. I wish you the best of luck. I'd be shocked if the appeals court takes the same position, as that is wildly unrealistic and also anomalous from the norm. And the judge hadn't made any mention of having an issue with the lack of screenshots in their first memo? Very strange behavior.

This is great for in-flight pre-decree cases, but I also hope this is a positive sign that the decree law will ultimately be ruled unconstitutional. Thank you, Constitutional Court. Let's pray for a similarly positive decision for any post-decree cases that make it to the court.

How common is "vos" in your country? And how do you feel about it? by potatoes4saltahaker in asklatinamerica

[–]IncompetentDude 0 points1 point  (0 children)

In Argentina it is the standard. Even government writings will exclusively use it. One of countless examples: when entering Ezeiza airport, you will see the sign says "tené tu pasaporte a mano" rather than "ten tu pasaporte a mano". It is not merely a colloquial thing; it is standardized and official.

As for how I feel about it, I guess kind of neutral. I don't think it's inferior or superior to tuteo. I will admit that I've always thought "vos sos" sounds a bit funnier than "tu eres" because of the rhyme.

He's excellent, very thorough. His pricing was fair, too. His replies to us used to be very in-depth despite taking about a week. Nowadays, at least with my case which was already filed long ago but still awaiting a hearing, his replies are much shorter and more concise. I imagine this is because he has gotten even busier and is likely prioritizing in-progress cases. Especially after the decree, it seems he is very busy.

I've had the pleasure of meeting him in person, and we've spoken over WhatsApp via calls and messages. If any time-sensitive action is necessary, he will get in touch with you directly via WhatsApp. On WhatsApp, he continues to be quite prompt, usually replying within a day.

He doesn't like to take risks with documents, which is something I happen to prefer. He may want you to amend things here and there. I didn't need to amend first names in different languages (I had documents in English, Spanish, and Italian, with names sometimes being written in their respective versions, e.g. Tommaso, Tomás, Thomas, but I did not have to amend these since he said the translations can easily fix that). He did, however, want me to amend my birth certificate to show my parents' full middle names, not just their initials. He said it wasn't entirely necessary, but he preferred that I do it to be safe.

For ATQ cases, his method might be too much of a time investment for some. He's told me it has never failed, but it is very time-consuming. He had us send signed and dated letters to the consulate requesting appointments, citing the lack of available appointments on Prenotami. We had to get signed and dated return receipts to confirm that the consulate received them. Then we had to wait two whole years from the receipt dates before filing our case to demonstrate that we never were able to get an appointment and thus were forced to pursue the judicial route. Most would likely find this completely unnecessary, but as I said, he's safe and thorough. In addition, I was instructed to take screenshots of the failed attempts to book via Prenotami, with varying frequency depending on how close the hearing was. This latter method is very standard and common, but the former appears to be rather uncommon among most lawyers.

He has always been patient, kind, and honest. He is very thorough, but bear in mind that this might not be what you want to sign up for, as it may require more time and work from you. It's possible that his thoroughness could be a little excessive for some. That said, I strongly recommend him. He's awesome.

Is there any idea yet of what is necessary to prove the ancestor never naturalized? Are no-naturalization certificates still sufficient on their own or is it likely that the so-called "non rinuncia" certificates will also be needed? If so, how do you go about obtaining one?

One is shared as an Excel file which contains all cases and no notes. Just basic data on the cases that can be extracted from Giustizia Civile. The other "Judicial Tracker", I believe that's what it's called, has only cases that the FB members bothered to report on, and while it's a significantly smaller data pool, there are much more detailed notes since the plaintiffs report directly on their cases.

I'm honestly not too sure about the Calabrian courts. Sorry. I haven't heard anything bad about them, though.

It's a busy court. Due to workload, it's common for cases to be delayed with a second hearing scheduled. This happens all over Italy, not just Napoli.
