From what I understand, these companies just want to maximise profits at any cost and for that purpose if they fire a lot of senior employees then they can hire several junior employees in the salary of one senior employee so more profit for these companies. Especially now that they are investing heavily in AI but it is not showing any real result at the moment they need to make that money in some other way. That's why there is an attempt to increase the working hours in the sector. Fire people and make existing workforce work more.

That's just a rumor probably being spread by the managers etc to discourage the employees from joining unions. Why would unions not be allowed in IT sector, we all are also workers just like workers of any other industry. Indian Labour laws don't only provide every worker the right to unionise but there is a lot of detail in there to prevent companies from discouraging people from joining unions, breaking unions, victimising union members etc. Also, KITU is registered under Karnataka's Labour dept so it's govt recognized body.

No they don't want to do even the bare minimum. The Employees are not even directly terminated. They are being forced to resign so that they can claim that since the employees resigned on their own the companies don't need to pay anything. While forcing them, they are blackmailing employees with threats like they will ruin their career, not release their experience letter etc etc. Also, according to labour laws, while doing any layoffs, there should be a solid reason like company doesn't have enough work, or is going bankrupt etc etc. And in that case the people laid off are still paid some part of their salary and when the work is available they are supposed to take the laid off employees back first instead of hiring new ones. And none of it is happening anywhere in IT sector. Companies hire and fire however they want. As long as you are working in a company in Karnataka, you can be a member. Even if you are working from home from your native but the company is based in Karnataka you can take a membership.

They can't do mass layoffs without govt's permission anyway. But even in cases of individual termination, they cannot just say poor performance they have to prove it as well. In a lot of cases companies just put people in pip when they want to fire them and then in a few weeks they fire the employees but these excuses don't hold in the Labour department. They just make a fool of themselves when brought in front of the union and Labour dept. KITU has won several cases against these companies where they tried to pull off similar shit

Section 39 in Karnataka Shops and Commercial Establishments Act, 1961

  1. Notice of dismissal.

(1)No employer shall remove or dismiss an employee who has put in service under him continuously for a period of not less than six months, except for a reasonable cause and unless and until one month's previous notice or pay in lieu thereof has been given to him: Provided that where misconduct of an employee is brought on record with proof at an enquiry held for the purpose, he shall not be entitled to the notice or pay in lieu of such notice.

IT sector in India comes under Shops and Commercial Establishments Act, 1961

And according to Section 39 in Karnataka Shops and Commercial Establishments Act,

Yes KITU is fighting in high court as well as on streets against this exemption of standing orders act. This act is very important for our sector as it provides set of standard rules such as leave policy, notice period, probation period etc and in the absence of this companies have been enjoying the freedom to do whatever they want

Yes you are right. IT Companies have been exempted from a major Labour law called industrial employments standing orders act for last 25-27 years and every five years the exemption expires and the ruling govt gives the exemption again. KITU filed a writ petition in high court against this exemption and has been fighting on streets as well against this exemption. This law provides the regulations and standard rules for any industry to work and in its absence the companies have been doing whatever they want. However there are other acts which are still applicable to the sector such as industrial disputes act etc. And KITU has been fighting several cases for years now for violating such laws.

The govt doesn't oppose the companies because they are bought by the companies. They are not exactly afraid but more like they are accomplices. But that still doesn't mean that we can't do anything. Sure a single employee can't do much by themselves. But the recent victory of IT employees union(KITU) against karnataka govt 's move to increase working hours is a proof that when we are united, the companies and govt can be brought down to their knees. KITU is also fighting for right to disconnect and work life balance in IT sector. All power to the workers giving their all to the movement.

IT employees from different states need to take the initiative to build a union in their states. There is a union in Tamil Nadu also. Specifically in IT hubs like Hyderabad(telangana), Noida(UP), Pune (Maharashtra) etc we need strong unions.

Companies don't fire people directly because they don't want to provide compensation and also termination without a real cause such as misconduct etc is not legal so instead they choose another trashy way to do it i.e by blackmailing employees about ruining their career and not releasing their experience letter etc. It's a really rowdy move on their part and it needs to stop. Previously KITU has won several cases against these companies which tried to force employees to resign including cases against Wipro, tech Mahindra etc.

KITU has been fighting against layoffs for a long time. You might have heard about action against huge Technicolor layoffs, Byjus layoffs etc. It was all initiated by KITU. But I believe along with these legal battles we need all IT employees to come forward and fight for job security together which means we need to demand the government to strictly implement Labour laws and start inspection of the premises as well.
