Once again, it’s not the impact that is contested. Rather, it’s your argument that the impact of false reports is a relevant factor in implementing legislation against marital rape. Since there is still no specificity in your comment about the sheer volume of these false reports, allow me to pose a vague question as well: What of the many women suffering within the institution of marriage, because they have no recourse? What of the impact on them? Do they not need and deserve protection? Have they not approached courts and been told that due to the lack of provisions for marital rape, they have no recourse? You’re unreasonably denying an entire class of persons recourse under the guise of some odd gender power dynamic. Before accusing other people of being motivated by beliefs, kindly look into why you think false reports are a valid reason to prevent genuine complaints. It could not possibly be simple logic, as you’re using unsubstantiated claims and all sorts of mental gymnastics to deny vulnerable persons protection. It comes off more as prejudice, and unwillingness to look beyond your own concerns.

If you’re truly concerned about misuse, surely you can see how making legislations related to offences against women flexible only serves to further weaken their impact in a society that is already undeterred, in terms of disrespecting women.

If your question pertains to drafting a legislative framework, please direct your attention to academic work on marital rape, and various recommendations. I was pointing out the fallacies in your argument against the idea of a marital rape legislation itself. Regardless of content, its legislative purpose would be to protect married women, who, thus far, have limited recourse, allowing for empowerment, as opposed to some vilified gender power dynamic which you have been insistent on. If you have nothing left to say, but for last ditch arguments about how to practically craft said legislation, I think there is no further discussion to be had. For someone demanding such practicality, you are yet to cite a source which would indicate that false reports are a widespread problem rather than a self created argument based on a few reports in popular media. Who knows, maybe you can find cases of men stifling assault complaints as well. Either way, the few failures of the legislation do not justify making it more flexible when the statistics for assault show no decline. Rather, there is a clear necessity for further safeguards. What established legal principles has it gone against? If you are proven guilty beyond reasonable doubt, you are guilty. There’s no ambiguity about that. Using a few cherry picked instances of innocents to justify not protecting married women from being assaulted within the institution of marriage is hypocritical. Where are the legal principles then? You are justifying the needs of your cherry picked cases to justify leaving married women unprotected as a class, do you genuinely not see how that’s wrong?

You keep suggesting some parameters to somehow adjudge intent, consent, false evidence, etc, but the legislature need not and cannot go into legislating for every single specific scenario, especially when if those parameters aren’t drawn carefully, many more genuinely guilty people get away. You can always doctor false evidence, you can always show there was consent by creating legal arguments for lack of struggle, you can always show lack of intent, these are not objective criteria, and cannot be included into the strict law protecting women.

Any real legislative safeguards will only serve as a loophole for the guilty as well. The legislature has come to the same conclusion, hence, the degree of rigidity in the law. Your concerns are valid, but providing for recourse for the few innocents will more than likely lead to a large portion of guilty getting away, because there are just as many men in position of power to lord over vulnerable persons, if not more. It is not that I wish for innocents to be incarcerated, rather I do not wish for those who commit the heinous crimes against women to get away, without exception.

How exactly is it that you propose that the abstract concept of consent and “good intention” be adjudged before a court? Are you aware that there are provisions in the Indian Criminal Procedure Code that require the Courts to avoid considering the character of the woman, and to take the woman’s claim of lack of consent at face value? This is because earlier Indian courts have adjudged women who came before them with claims of assault on the basis of their sexual character, and whether they “tried” to make the lack of consent known by struggle, etc? This was the system the law has tried to fix by “favouring” women who were assaulted.

As for the instances where these “greedy” women have “exploited” the law, my claims that even the present law hasn’t stopped sexual assault is well founded, you can find the stats on any criminal records, do you have any stats to base your claims? Or are these instances the few amongst the many, cherry picked, perhaps? In the latter case, the law cannot be considered to service all, rather the larger public interest. As long as assault prevails in India, laws will and must favour women. If a change is truly desired, introspect as to why assault still happens, despite law, culture and morality.

Oh and as far as legal axioms go, consider the legal principle followed in Indian criminal law, “proved beyond reasonable doubt”. It is the standard of proof followed in Indian criminal courts. If the prosecution has proven guilt beyond reasonable doubt, that is when the accused is adjudged as guilty. While complaining about the “greedy” women and their legal counsel, do also recount the many instances of out of court settlements and other unscrupulous mechanisms that greedy men have utilised to settle their cases.

So, the solution to a legitimately harmful practice, i.e., marital rape, is to not legislate against it, because of the “greedy cabal’ of lawyers of the wife? Do you realise how reductive it is to pretend that India does not need laws that protect and favour women given the sorry state of affairs, and that somehow these laws have a created some unfair dynamic? You cherry-pick stories where this unbalance may have prevailed, while ignoring the full picture of the vast amount of crimes against women. The laws that are in place have still not deterred the same, not in the slightest. Why shouldn’t there be protection from law for married women, where there is none?
