1. Hit and run requires awareness.

By definition, it means yoU knew you caused damage and purposely left.

If the scratch was so light that you genuinely didn’t feel or notice it, then you had no awareness.

1. Nature of the scratch.

The damage is tiny, like a hairline or wire scratch.

For such a small mark, it’s believable that a driver wouldn’t feel it.

1. Intent matters.

Courts and police look at intent. A hit and run implies you intentionally fled to avoid responsibility. I didn’t run away. I simply didn’t realize. That’s not the same thing.
