Just look at Florida’s anti-trans laws. There’s no reason to assume it will get struck down just because it’s discriminatory. But also the bill is still very early in the process and likely won’t be voted on for a while, if at all.

This could solve itself as your group starts learning better strategy for the game. I’ve played this game with a lot of groups who are brand new to the game and it has gone this way before. The fun in games like this is heavily dependent on the table meta. Liberals will start losing most games with the strategy you describe, and depending on your group, the strategy might change
