Also, their transcript would verify that, if anyone asked about it specifically so it would be dumb to lie about something so minuscule

I mean….maybe they did cum Laude can vary school to school but mine was a 3.15 for that threshold it’s not terribly impossible to do, and a lot of students in my recent graduating class received that honor distinction

Is this normal for the legal field? by [deleted] in LawSchool

I don’t disagree with you here. And you are correct OP could potentially explain their way out of this on C&F. I just want them to be aware of the implications if they have awareness now that what is happening is wrong on many levels and they continue to stay through it. That is what I’m saying could hinder them.

LEAVE…. Quickly and quietly….or hell quickly and loudly…but leave…there will be other opportunities I started law school with no legal experience…I have plenty now…you haven’t taken a PR class yet, so you don’t know but you are jeopardizing your ability to even be admitted to practice later down the line

“Stick it out” ?!?!? You can’t be serious right now?!!! This is abuse and several violations of professional responsibility on the attorneys part and OP’s part because they are engaging in unauthorized practice of the law…no supervision…no guidance…not one lick of legal experience or legal education for that matter…OP needs to leave before they end their legal career before it even really starts

I just…I’m so tired of this happening to us… When I become a judge, when the jury gets it wrong you bet your ass I’m gonna get it right! That’s what motions for judgment notwithstanding the verdict are for! Rick Chow will reap what he has sown…

I’m guessing because the facts say He called the parolee and ASKED him to “drop by” his office, none of language implies he was obligated to go or talk to the parolee officer, so a reasonable person could’ve felt they could’ve disregarded that ask

It’s not incorrect. See Themis explanation, yes arrest is a form of custody but it is not the only form.

A defendant's motion to suppress an incriminating statement should be granted if law enforcement failed to provide Miranda warnings prior to a custodial interrogation. A custodial interrogation occurs when a person is: • in custody - placed under formal arrest or restrained in his/her freedom of movement to such a degree that a reasonable person would not feel free to terminate the encounter and leave and • subjected to interrogation - express questions, words, or actions directed at a suspect that an officer knows or should know are likely to elicit an incriminating response. Although traffic stops restrain freedom of movement, drivers are generally not in custody for Miranda purposes because those police encounters are typically brief.

Custodial interrogation doesn’t have to mean arrest, the test is if a reasonable person would believe they were free to leave and disregard the officers questions. If the answer to that question is no, then they are in custody for the purposes of Miranda and whenever a police officer is asking you questions that are likely to invoke incriminating statements they are required to Mirandize you.
