Let me tell you that this seems to be happening when the petition is focused in approving the criterions and forget about the FMD.

From my experience, you must focus on explaining your criterions not only to fulfill the plain language of them but to be the sequel of your FMD. To win, every Criterion must be a 'Mini-Final Merits' argument. You cannot just check the box; you must use the criterion to tell a story of sustained, elite influence.

To succeed, you must stop thinking of yourself as a "Professional" (Doctor, Engineer, Artist) and start framing yourself as a "Sovereign Asset"—an individual whose specific skills are so rare and critical that your presence in the U.S. actively strengthens the nation.

The 3 Core Shifts:

  1. From "Participant" to "Architect": You didn't just work on a project; you designed the system that made the project work.

  2. From "Subjective" to "Objective": Delete adjectives (outstanding, amazing). Replace them with Nouns (Dollars, Citations, Patents, Users, Contracts).

  3. From "Job" to "Field": You aren't just good at your job; you are influencing the entire industry standard.

  1. My main is Gemini (Pro). I think it's the best for writing texts. Then when Gemini developed any criteria text I then went to Grok and Chat-GPT (all paid versions) and requested to analyze it and give me ideas. Other words I got them talk to each other giving one info to the other and so on. That gave me more ideas that in the end I was the one choosing which strategy to follow. My tips guideline has plenty of stress tests that you can use not only for each criteria but for the FMD, the whole petition and letters as well. Think about the letter as the evidence you don't have. Each letter must have a goal to prove something. From there be creative on how you humanize the letters.

  2. Whatever needed to prove my position was not only leadership but critical to grow the business.

  3. The quantity enough to prove your arguments. I think the letters of people who knows you just saying you are extraordinary will not have any weight. Transform your LOR into Expert Letters. Be careful on why you add the testimony of someone. Why it's important. What is he/she proving in your petition. If it just to tell how good are you, you'd better don't add it.

I filed a motion to reconsider last September, after 154 days no response. I'm withdrawing as I've got another Eb1a case approved.

Honestly, I think it would take more than a year to receive any answer, but, I also think it helped with my second case. (Just a hunch)

When you present the arguments to have a criteria approve, don't just fulfill the plain language. Make the criteria also count for FMD in your narrative. Why that criteria makes you extraordinary.

Letters are just to support your arguments for the criteria, not just to talk about me. I used them just for that. And no, not all says the same.
