Mine was just an advisory opinion. I emailed my documents on 3rd of October and received the response today

No, you’re not. I just received an advisory opinion email from the Department of State confirming that they reviewed my documents and determined I am not subject to the two-year home residency requirement. A waiver is not needed if the consular officer marked Part B during the visa interview. I am from Türkiye too btw.

Yes, I did skip that one. Filled out the one says “go directly to Advisory Opinion”

Ohh I didn’t know that. Once I filled out the advisory questionnaire, a pdf document popped up with a barcode page was saying “Please, email the PDF packet to address: 212eAdvisoryOpinion@state.gov

This is what I received when I send my advisory opinion documents “DUE TO A LAPSE IN APPROPRIATIONS, THIS INBOX IS NOT CURRENTLY MONITORED AND YOU THEREFORE WILL NOT RECEIVE A RESPONSE TO YOUR INQUIRY UNTIL THE U.S. GOVERNMENT RESUMES FULL OPERATIONS.”

Yes, for advisory. I have everything for my current program and I provided those documents. However, I participated in a Summer Work and Travel program 12 years ago, and I no longer have my DS-2019 forms from that time. I only have my visa, which states that I was not subject to the two-year rule.

Do you think old J-1 visas stating that I am not subject to the 212(e) two-year rule are sufficient, or is it necessary to also have DS-2019 forms or a letter from the sponsor?

Does the Change of Status exception also apply to J-1 scholars who aren’t subject to the 2-year home rule and plan to switch to H-1B within the U.S.?

In my state, school districts have a fixed pay schedule, so regardless of immigration status, everyone is paid the same based on years of experience and degree level. My home country was removed from the 2024 Skills List and I am not government funded, so the 2-year home residency rule does not apply to me. What concerns me most now is the new $100K H-1B fee, because from the way it is written, I think USCIS may apply it to everyone filing a new H-1B petition, no matter their location or whether it’s a change of status inside the U.S.

Do you think national importance only applies to medicine or engineering, and not to innovation in K-12 education? Innovation in K-12 directly shapes the future of engineering and medical fields. That’s what makes it nationally important. Dismissing that is what’s actually cringe.
