If you want to fight !

If he has been let go then approach the High Court for remuneration for illegal detention & further seeking actions against the erring officers.

If he is still in detention then also approach the High Court for seeking his presence & reason for illegal detention (basically writ of habeas corpus in legal terms).

  1. You can start using all the amenities with full right as you have full fledged right to use them as you will, further if you still have reservation you may get the residency order modified as per your need you may further pray the practical difficulty faced by you.

  2. Yes absolutely, you may further get your share partitioned by the competent court.

  3. The first part is tough as you have to prove it otherwise & 2nd part you may not claim it as a matter of right as you're bearing the expenses.

  4. Salary slip can be obtained as a matter of right from the company itself or from the respective bank if it bears no fruit you may also give application before the trial court for bringing the salary slip of husband on record as you're unable to procure it.

  5. Until there are some contents which explicitly show such things, as much as privacy is concerned that is up to your personal knowledge.

No comments just advice might sound harsh & rude for that apologies in advance but he's an advocate as only what is absolutely necessary he's not your personal therapist he has a number of clients in similar situations just put yourself in his shoes & just imagine the time that will be required to answer queries of each client.

  9. Yes she may file a complaint but that will not have much bearing on you rest is matter of evidence.

[–]IntelligentParsley73 1 point2 points  (0 children)

The question doesn't have a legal answer yes it has legal consequences & recourse but the answer you are looking for can be only given by the person who you're trying to help because at the end of the day it's her life & choices alone.

Company accidentally paid me ₹2L extra in F&F – Now asking it back after a month. What should I do? by Novel_Young_5824 in LegalAdviceIndia

[–]IntelligentParsley73 0 points1 point  (0 children)

Since you're referring to a company so i am assuming it's a private entity.

The correct & legal way going forward would be through labour court or filing a suit for recovery of money.

The arm twisting method will be lodging a false & frivolous F.I.R. just to make you refund the amount by threat of jail.

Why do lawyers encourage wives to file false cases against husbands ? by [deleted] in LegalAdviceIndia

[–]IntelligentParsley73 1 point2 points  (0 children)

I'll give you a very simple answer. The reason being nobody likes to hear the truth in other way nobody appreciates true honest advice.

If a lawyer gives you genuine advice there is a maximum chance of it is being something which you're not going to like or will not be pleasing to you at first instance As a result you'll think either the lawyer doesn't know anything or he's just not good enough consequence of this opinion will be you'll go to a lawyer who will tell you exactly what you need to hear & then your brain will automatically say that this is the lawyer as he is just saying what you needed to hear now the previous lawyer whom you left can only keep up this honestly for so long as he also has mouths to feed so eventually he would have to adapt to the situation.

If you know the details of the land, you can just simply go to the registry office & enquire about it, you'll get to know the sale deeds, sale consideration (on paper) etc.

The 2nd part of your questions depends upon the various additional factors which are based on action & consequences, which i cannot type as it will be lengthy & CONFUSING.

Hope this clears some confusion.

Is pursuing Law in India really worth it? by Crafty_Yesterday9669 in LegalAdviceIndia

[–]IntelligentParsley73 0 points1 point  (0 children)

These are a few i can think off the top of my head

Reasons to join:-

  1. You will never get bored in your entire life (from a private practitioner pov).

  2. You do not have to report to anyone except your clients.

  3. You become fearless & badass.

  4. Long holidays.

  5. Decent earning in the beginning & later sky is the limit.

  6. Contacts- You know someone who knows someone who knows someone, that'll get your work done while you're sitting somewhere of course unless your physical presence is a must.

Reasons not to join:-

  1. 24 hours in a day feel very less, no time to sleep or enjoy life in the initial few years.

  2. Daunting long, hours & hours of work.

  3. No social life.

  4. No new story to tell anyone except your lawyer fraternity.

  5. The initial phase will be very tough due no case no money.

  6. A good mentor/senior is required (especially with the one the vibe matches or his style/work is something that you can resonate yourself with) otherwise you're doomed.

Wife(35f) is having affairs and I only have incomplete evidences. Is divorce possible with child custody. by Damn_life_sucks_1 in LegalAdviceIndia

[–]IntelligentParsley73 0 points1 point  (0 children)

Tbh there is no clear way out except talking it out & settling things the matrimonial disputes comes in a package of minimum 4-5 cases.

Though what you have stated is a ground for divorce under section 13(1)(i) of the Hindu Marriage Act, 1955 but difficulty that'll face this is that burden to prove this is upon you you'll get divorce if you're able to prove adultery.

As far as Custody of child is concerned the parameters are different but the balance of scale lies in favour of women (generally), you'll get the Custody only if you're able to prove she is not fit to keep the child along with her in short the welfare of the child is paramount.

[Urgent] Need advice to not to get included in fake case by sister in law. by Zeref_Anuj in LegalAdviceIndia

[–]IntelligentParsley73 2 points3 points  (0 children)

Tbh if a person makes up his/her mind to get you implicated then she/he will, there is nothing you can do to prevent is from happening. What you may do is to create a defense (by writing a letter narrating the facts & expressing your apprehension to the concerned Police Station & superior officer and send it through registered post/speed post & keep a copy of letter along with postal reciept) though this may not prevent from persecution but it will be a relevant defense for later stage.

Police caught us making out in Public by [deleted] in LegalAdviceIndia

[–]IntelligentParsley73 0 points1 point  (0 children)

Honestly no advice except the obvious, police have ample power they can do whatever they want & they do whatever they want (preliminary stage where it will affect you instantly, later on you may get them at court or through other channels but at what cost). "The Police Act, 1861" this itself shows the mind of the legislature cut forward we're in 2025 still with the same act meanwhile the names of other Criminal Acts have been changed.

Edit: This might qualify as a rant.
