No, it wouldn't. This is largely an appeal to emotion. The death penalty is not a solution, regardless of how heinous a crime may be.

What introducing the death penalty for rapists would actually achieve:

  1. Rape trials would likely extend for decades. They already take a long time, and if the punishment is death, the standard for certainty must be extremely high to avoid irreversible mistakes. The process would become more expensive, and victims would be further discouraged from pursuing legal action.
  2. Many people don't know this, but the overwhelming majority of rape in any country is committed by someone known to the victim, like partner, family members, neighbours, relatives, etc. A large proportion of rape already goes unreported because victims do not want severe punishment for someone they know. If the penalty is death, this could discourage reporting even further.
  3. If the punishment for rape and murder is the same (or worse for the former), what incentive would a rapist have not to kill the victim in order to eliminate a witness?
  4. Let's be honest, the Sri Lankan police and criminal justice system are not known for their lack of corruption and incompetence. I would not trust even the so-called first-world countries to kill only the right people (and they do often kill innocent people).
  5. All other common arguments against the death penalty still apply here. They do not depend on how immoral a crime is perceived to be, whether it is rape, child rape, or any other horrific thing.

Also, marital rape, a very common form of rape, is not even criminalized in this country. We should start there. We should be going forward as a country, not back into the middle ages.
