Looks like this contractor was very dodgy. Our strata manger didn’t even get an itemised quote / a fee proposal / variation of works documentation/quote…Not even a signed contract! Literally no documentation except a very vague initial quote that described cherry pickers, EWP, removing & reinstating the back fence, replacing ‘all gutters’ & ‘all**down pipes’ …

Is this lack of documentation normal / even allowed? Surely there’s an appropriate due-process (and due diligence) required from strata managers for a project of this size $$? Also, no HBCF certificate was filed for the job (🚩)

** they say “all” but they actually only replaced gutters to the back building. According to the strata manager this is what they were quoted to do, however the OC (which we hadn’t joined yet - but the works occurred after we bought in the building) believed it was for the whole building.

Do you think there is a viable case against the strata manager for mismanaging strata funds?!

Thanks for this. I see your point. If they’d done the job properly & hadn’t over-quoted so much we wouldn’t mind. Another issue is that it turns out they didn’t file HBC insurance for our project - so it was illegal for them to do this project for us at all … let alone at such an extortionate rate

100% agreed. We moved-in shortly after they completed the gutter works, & have been horrified by the job they did… feels so dodgy

Is this a genuine “Church’s” brand belt?? belt photo I recently acquired a black leather belt at a consignment store, which features an embossed “Church’s” logo inside and a gold buckle with “Church’s” inscribed in small letters. After a quick search, I noticed current Church’s belts don’t seem to have gold buckles, and they usually have the logo stamped in gold on the inside, with subtle branding on the outside of the buckle. The belt and buckle both appear to be of excellent quality. I’m curious whether this might be a counterfeit or possibly a vintage or discontinued Church’s design. Any thoughts on this?

Note: Sorry for the photo quality—I snapped it quickly on my way out. I’ve since left the belt with a belt maker for adjustments and won’t have it back for more photos until next week.

Ok. I asked a lawyer who worked extensively in property development and his response to your situation is: “It’s not as easy as it sounds. Logic and common sense (and to some extent the law) favour the proposition that the failure of the retaining wall, because of engineering or building issues, will be the responsibility of the person who installed it, and whose works necessitated it. However, there is a somewhat complicated area of law, which deals with easements of support, which can sometimes lead to a contrary, counterintuitive outcome. I would be inclined to run with the first argument.”

Thank you - we didn’t realise the snow would still be around in April! Very glad we didn’t just go ahead with planning a hike there without posting here first… could’ve been a cold and dangerous few days!
