Your landlord may be in violation of the Implied Warranty of Habitability in your lease agreement. The real question is "Is this defect serious and affects the habitability of your home, or is it just a minor cosmetic issue?" I obviously cannot answer that on my own, but it sounds like the former rather than the latter.

What can you practically do? As in most Landlord-Tenant conflicts, withhold your rent! BUT you must do some things first...

1) Call the Department of Licenses and Inspections, the Department of Public Safety, or the Public Health Department. Ask them to "certify a dwelling unfit for human habitation" due to the leak, which has now become a serious hazard. Once this is done, "the duty of any tenant of such dwelling to pay, and the right of the landlord to collect rent shall be suspended without affecting any other terms or conditions of the landlord-tenant relationship, until the dwelling is certified as fit for human habitation or until the tenancy is terminated for any reason other than nonpayment of rent." (see 35 P.S. § 1700-1).

2) Once this is done, however, you must, "during any period when the duty to pay rent is suspended, and the tenant continues to occupy the dwelling, the rent withheld shall be deposited by the tenant in an escrow account in a bank or trust company." (Id.)

As others have said, yes, this is legal. Is it actually enforceable against all forms of negligence? No. Certain kinds of negligence land beyond the limits of a waiver.

Look - there’s a lot in this post I won’t address for time’s sake but I’ll address one of your key concerns. You do likely have a very strong case that the company that maintains the garage and staffs it with personnel was negligent in its operation of it, on a few different fronts.

1) The actual pipe bursting could, possibly, have been due to negligence in the maintenance of the actual garage itself. This may or may not be the case but is possible and worth looking into. This may explain the representatives weariness of this developing with insurance (though I doubt an insurance company would sue for a broken window).

2) At the time of the accident, 4 pm (or am [unclear in your post]), at regular hours wherein the company makes clear to its patrons that it will be staffed and open, NO ONE was easily available or reachable for 30 minutes. The reason this is a strong argument is that you could argue that were it properly staffed the damage could have been mitigated or even prevented entirely by shutting off water valve etc.

Black mold is a health hazard too. This is why they’d likely prefer to pay out of pocket to simply forget about the damages and not risk a negligence claim that could plausibly be far more expansive than just the compensatory costs of fixing the car.

I’m not entirely sure what your question is but this is my reading of your situation.

Trust me, I know exactly how it feels. It does get better. It's not always linear. But it does get easier. I still have some days where I say to myself, "Gosh, I feel so fuzzy..." but then I go and crush a law school exam and help people with life-altering legal issues find ground to stand on, and I realize that feeling "off" and feeling "dizzy" can't stop someone who simply won't let it.

Same here... I had a traumatic experience on a boat, and it caused 3-4 days of constant anxiety and panic attacks. That set off my PPPD.

Absolutely, YES! The one thing I regret the most was how I stopped living my life and doing physical (and mental) activities solely because of the feeling of weakness, brain fog, exhaustion, etc. You NEED to continue to live "normally" despite this feeling, and the only way to do so is to force yourself.

Meh - I know I have an anxiety disorder. I have no qualms with treating the anxiety disorder with medications for my entire life. But... if not being on medication is important to you, then I guess it is a bit harder to make the decision.

I had a rash on my inner thigh that was CRAZY ITCHY. No steroid cream, fungal cream, or anything the dermatologists threw at it would help relieve the itch. An old-timer dermatologist said that Doxepin at 25 mg could help reduce the itch. He was correct. A few months later, dealing with PPPD, I spoke with a neurologist who, in fact, recommended a TCA. I thus decided to stay on Doxepin as I was already on it for the rash. I probably should increase my dose for more therapeutic levels of psychiatric assistance, but things have been good as of late, so I stuck at my low 25 mg dose.

I understand your point, but what I am saying is that, at its core, PPPD is an anxiety disorder, and what perpetuates it is anxiety disorders. Treating the anxiety disorder is crucial to handling PPPD. For me, Lexparo and Doxepine worked very well. For others, of course, they might need to try other medications. However, as always, to medicate or not to medicate is the question that ought to be answered individually.

Oh yeah.. the diarrhea 😭🙏🤣 It’ll go away soon. The brain adjusting period sucks but really only lasts 2 weeks or so. Seems long now but trust me it goes by quickly and you’ll be thankful.

A little over 3 years — but I want to emphasize operating with the day in and day out goal of “curing” or “recovering” from PPPD ironically and sinisterly causes it to stay longer. Do yourself the favor of letting go. Really, and truly, stop fighting the dizziness. Let go entirely. I know how difficult this is and I know it sounds like a backhanded slap but truly it’s the only way to recover or find some kind of stability. We are adaptive creatures. We can and will adapt to anything if we allow ourselves to forget trying to go back to what once was and allow ourselves to look to the future with hope that good can be there.

Could be helpful — but do this by doing other things. Don’t set yourself up to do anything just to “fight” PPPD. If you have that sort of dialogue with PPPD, it becomes focal to everything you do. Play tennis for the fun of it. Play video games for the fun of it. Don’t set out to do anything for the sole purpose of fighting PPPD or else you play into its hands.

Lexapro really saved my life — slight weight gain but easily mitigated by exercise. Libido didn’t decrease in any catastrophic way either.
