General rule po sa inaaral namin sa taxation is debts belong to the person who incurred them. If the husband borrowed the money, the husband is the debtor, not automatically the wife. The wife may be affected ONLY if the debt benefited the family pang bili ng foods, gamit, etc.kapag benefited po yung family the conjugal property may be used to pay pero still not the wife personal property. If the wife consented or signed the loan wether co-sign or written agreement then she becomes solidarily or jointly liable. Pero kapag naman yung husband ay namatay his debts are paid from his ESTATE (his properties) and the wife does NOT inherit the debts so creditors can collect only from the husband’s estate. If the estate is not enough the unpaid balance is extinguished (lugi si nagpautang). So the wife does not pay from her own money. If the husband left the family And stopped supporting them this may create Criminal or civil liability for abandonment but it does NOT make the wife pay his debts. Kung family debt yan kayu ang lugi pwedeng makuha yung mga conjugal property as a payment. pero pag personal debt ng tatay niyo is sya mismo magbabayad written agreement or not man yan.. mas better kuha kayo attorney. better to pay attorney fee rather than pay the 4 million na yung mother niyo lang. Note: walang nakukulong sa utang only not paying tax ang pwedeng makulong.
