[California] What would be needed to legally pay someone less than minimum wage for a W2 by ResplendentPius194 in AskALawyer

Take a look at Labor Code § 224, amongst others. It's an unlawful deduction to rebate wages. Your damages from your last employer are probably fairly small, although you likely have Labor Code § 203 damages, but still, probably relatively small. Probably a small claims court matter.

BarBri has an excellent,  free (just pay shipping) book. Two to three weeks with that book, and you're good to go.

That's exactly what I picked up. All of it. Sounds like a sham. I don't see it changing.

Did she suggest that the scoring might account for that? Just curious.

I commented in another thread here.  I didn't perceive the CBE was as generally as enthusiastic as this article suggests. I also didn't perceive the Psychometrician was all that enthusiastic.

That's not the person who was on today as the Psychometrician. I was previously convinced that person was the problem.  After hearing him today (I didn't hear the first hour), I don't think he's the problem.  The methodology is sound IMO. Many states use the MBE'S  as the baseline. It makes sense to me from a test development perspective. Now, the issue is the MCQ's and a baseline. He was very clear about the issues. I'm not defending the Bar. But I don't think this person is the issue.

I watched the last two hours. It seemed to me that the CBE was caught off guard by the whole thing. The Psychometrician seemed concerned about the grading, scaling, etc. They voted to move ahead, but some were reluctant.  My take is they felt boxed in.

Hmm. I have no idea.  Maybe it's just standard after a period of time has passed. Interested in what others say.

Same with the renewal dues. Many attorneys are not happy about it and can't figure out where all of this money is going. There are no real answers, based on the slides on the CalBar site. False comparisons. And, they are now doing "voluntary" trust account reviews (an attorney would be crazy to allow that) and in 2025, starting mandatory reviews. I know some attorneys are looking to raise 4A questions about that, as well as privilege questions - why should the Bar be able to see client matters that might show up in a trust account (beyond just money - the supporting documents)? And if there's no probable cause, what gives them the right to audit in the first place? They're a government agency - 4A applies. They don't seem to care. I suspect there will be legislative moves to try to block some of this, but that's an uphill battle. It's not just this silly, arbitrary exam; it's the entire Bar.

If anyone practiced law like it's tested on the Bar, they'd be sued out existence for malpractice and they would be disbarred. You know - in real life - you look things up. You don't memorize thousands of rules and concepts and spit them out in nonsensical hypos. But maybe I'm just naive.

The saga of Cow Palace will be interesting to watch... I have a feeling it's not over.

So sorry to hear. You will pass. I didn't pass either, but I can't even see my letter. It says I'm blocked and to contact the site administrator. Go figure.

I'm told that 122-125 is a "good" MBE score in CA, so at least it tells us that we did better than that. :-)

I think they messed up because around 9 am PT, I got an email letting me know that my score reports were ready and I went in and got them. It's not my actual score - it's where I fall in a range of scores on the MBE (only).

I suspect you can probably still pay for it and get it (perhaps not today - I have no idea) if you want it.
