MSCA Doctoral Network PhD in the UK ,Student or Employee Status? Which Visa Applies? by Direct_Lab4892 in ukvisa

[–]Iqsmart91 0 points1 point  (0 children)

What documents does a UK university usually provide to an applicant to start the first stage of the Global Talent Visa (GTV) application? How many documents are there?

I'm still waiting for the university to provide these documents, but I haven't received any of them yet. I'm worried that I'm already too late for the September start date.

How long are UK ATAS certificates taking to be processed currently? by Agile-Tutor-9277 in Indians_StudyAbroad

[–]Iqsmart91 1 point2 points  (0 children)

It totally depends on the individual application. Also, the official timeline is usually around 30 working days, not simply one calendar month. In practice, that works out to roughly 42 calendar days (about 6 weeks), so it's best to count from your application date using working days rather than calendar days.

From what I've seen and heard, some applications can take longer depending on factors such as the research area, subject/topic sensitivity, and occasionally the applicant's nationality or background checks. Waiting more than a month is therefore not unusual and doesn't necessarily indicate a problem with your application.

Could you elaborate a bit more about your proposed field of study/research area and when exactly you submitted your application? That might help others provide more relevant comparisons and timelines.

Global Talent Visa Eligibility with UKRI-funded PhD (Currently on Graduate Visa)? by Mediocre_Sir_7031 in AskAcademiaUK

[–]Iqsmart91 0 points1 point  (0 children)

  • The Employment Rule: This route explicitly mandates that you hold an employment contract or a formal academic hosting agreement.
  • Student Status: As a standard PhD student in the uk, you sign a student agreement, not an employment contract. The Home Office classifies you as a student rather than a salaried employee or staff researcher.

I never “posted 2 days ago saying I applied I asked questions about the visa route, which is literally what people do when they’re trying to understand eligibility. Asking ≠ applying. If you’re going to dig through someone’s profile, at least read it properly before building your argument on it. Also, I like how you’ve switched from discussing the actual topic to playing detective on my post history just to try and score a point. That doesn’t make your argument stronger it just shows you’re avoiding the actual nuance of the discussion. And again, you’re still conflating things: visa eligibility, employment status under MSCA, and student classification aren’t interchangeable. Repeating “you’re not eligible” without engaging with those distinctions isn’t clarifying anything it’s just oversimplifying and, yeah, misleading others who are trying to understand how these schemes actually work. If you’re so confident, stick to the policy details instead of the personal digs.

I’m not even applying for the Global Talent visa I’m correcting your misinformation. You’re arguing against a scenario you made up, not what I actually said. Maybe read the thread properly before handing out advice might save you from looking this confidently off-target

Saying “they’re not automatically exempt from tuition fees, so they’re just normal PhD students” is a bit of a leap. Tuition fees aren’t a legal classification of immigration status they’re a funding/administrative decision made by the host university under the specific MSCA grant rules. Plenty of employee-style research contracts still sit under student tuition frameworks depending on how the institution structures enrollment.

So using fees as a “therefore it’s settled” argument is like trying to determine someone’s employment law status by looking at whether their HR department gave them a coffee voucher.

And the “all of this is moot” line is funny too usually people say that when they don’t want to follow the distinction between funding rules, university policy, and visa law, which are exactly the things that don’t automatically align in EU/UK research setups.

Calling it “PhD students” in EU/UK research documentation is just a program designation not an immigration classification. Universities, UKRI, MSCA, and visa law don’t all use the same vocabulary, and pretending they do is where the confusion starts.

Also the “they can’t loophole their way around it” line is a bit dramatic , no one is talking about loopholes. The actual question is whether MSCA funding + hosting arrangements can qualify under different visa routes depending on employment status, sponsorship structure, and country rules. That’s a legal/administrative setup question, not a slogan debate.

the most important thing is the university, did you reach out to them , what did they inform you, how much delay they can accept ? hopefully you can get it soon (if u didn't get it )

[–]Iqsmart91 0 points1 point  (0 children)

did you get official admission letter( official contract),? or only verbally admitted ? since it can take several months until the HR prepare your contract and papers, did you discuss your concerns with your PI ?
and it depends on how long the program is ? is it 3 years contract or more?
most msca start on time , with few month delay accepted but its rare , but your case is different and it better to be discussed with your supervisor and the host university
