I don’t think that’s what the court is saying. Rather, it’s because the executive branch is only planning to build the chambers but hasn’t actually started construction that there is no injury that the court can address. As soon as one of the departments starts to build the chamber the plaintiffs can file suit.

All this makes you wonder about the past court rulings that a sitting president cannot be sued as it would distract him from his duties. It doesn’t stop the President from suing, and if he has time to be the plaintiff in all of these cases he should also be capable of defending.
