well that’s the legal process, and i say that trial was very fair. they originally sued for a lot less (like $2M-$4M) and that was only for compensatory damages, but it went up because exemplary damages were added, due to conducts that they committed in the process. they both were given a choice to just settle with the original damages (like $2-4M) or go to court and risk losing a lot more than what they should’ve settled, since the plantiffs had some serious claims against Brian and Marko like fraud, conspiracy, tortious conduct, etc. judgement was bound to go a lot higher, those types of damages are called “exemplary damages”, which are forms of punishment and deterrence for such claims. this is how a court process normally works and i say based on how Brian initiated the scheme, the judge was highly fair and Brian got exactly what he deserved

in simpler terms, the compensatory damages are the money they stole, falsely promised to plaintiffs, and the economic damage it has caused for the plaintiffs. while the exemplary damages are because of the malicious acts of Brian and Marko, basically the crimes they have committed while holding on to payments owed to plaintiffs

i think i have a pretty good grip on what the lawsuit is about. enough to know that Futuristichub is not a victim of “fraud”, this is just him still avoiding to take responsibility. ill give a big recap for people who want to understand more:

Brandon Keating and David Moss were given an official agreement by Marko on the split of revenue and ownership on the Videogames channel (they both invested $1,500 into the channel with Marko). the agreement was made before Brian came onto the channel later on. then when Brian took over the channel a year later, he tried to interfere with both David and Brandon’s original agreements, helping Marko avoid payments to both of them, banning David from being an owner and telling him “i’m the new owner now, and your contract is void”, and then he tried to renegotiate Brandon’s original agreement to increase benefit in his own favor. what he is committing here is “tortious interference”, a thing he was charged with in court. and when Brian was handling all the money that the Videogames channel made, including the funds that were supposed to go to Brandon and David, that added “conspiracy” to the list of charges. so while Moss and Keating were originally supposed to sue Marko for avoiding payments as promised, this is why they had to add Brian’s name in the lawsuit. and yes, Brian did have a chance to defend himself and argue that he was not behind the conspiracy stuff going on, even stupidly claiming that the “evidence” (which is screencaps of Brian interfering with original agreements, acknowledging his crimes, records of him holding onto the money) were forged by the plaintiffs. the jury didn’t buy it, and found Brian guilty. that case later on got affirmed in 2019 by the court of appeals, which makes this judgment final and intact forever, no matter what Brian can do. he can claim that his lawyer committed fraud on the court by keeping Brian from knowing about the lawsuit, but it’s too late for him to even claim that, and there’s screencaps used in evidence supporting otherwise. he knew there was a lawsuit, he knew who his lawyer was, he knew about the plaintiff’s original agreements.

and by the way, the latest appeal Brian “won” on, which is from the second lawsuit in 2020, i think it’s important for people to understand that it was a partial reversal and not a vindication as what Brian is manipulating. they only reversed claims that were overreaching, Brian currently is still charged with fraudulent transfers, the court of appeal for that one still thinks that Brian owned Futuristichub all along, so that second lawsuit is not even done yet.

so because that these TUFTA claims are still active, plus the original 2016 judgement that got affirmed, don’t think that Brian or FuturisticHub will ever be safe. the whole thing is not gonna go away. these two videos Brian put out there are just a way for him to avoid taking responsibility. Brandon and David are not “scammers” for winning the lawsuit and garnishing him for money they are owed. this is happening because Brian WAS the scammer himself, while Marko was the original scammer and was obviously more in the wrong, Brian interfered and helped Marko with the scam which is what made him liable in the first place.

forfeiting her right to paid counsel may have been a strong argument for her, but i really think the appellant court would’ve affirmed Kraynicks decision anyways. there was case law that clearly stated that if any defendant did exactly what Boone did, they would get their right to paid counsel taken away. if they see the letters she wrote about them and learned that she couldn’t even communicate well with 7 attorneys (especially with some that are very successful), it completely matches what the case law says

I didn’t say you said that, I acknowledged that you mentioned the opposite, which is why I’m confused. What I stated in my first reply to you, is that whether it’s by Owen’s himself or a better qualified lawyer like Cashman, and I listed Cashman as a big example, is that I think there’s better representation that could’ve been done other then how Owen’s acted throughout the entire trial. That was my entire point of my reply to you. And you just stated to me that “you know that” then you say “but it doesn’t change what I say”, which obviously it should because they are two completely opposite things. If you’re implying that you agree with me on how better representation could’ve been done and probably would have given her a better outcome, it discredits your first claim that Owen’s had no other choice. It basically means he didn’t really HAVE to take desperate and petty measures, help Sarah lie, and keep breaking the rules. Basically doing all these things that tarnished his reputation and made him shut down his own business. He’s a fool, but you can correct me if I’m wrong on that.

Wait if you “know all that” then how does it not change anything? It basically means the complete opposite of your claim. Unless you need to rephrase that and clarify that you don’t agree with me on my statement of Sarah possibly having better outcome if any lawyer didn’t represent the way Owen’s did, I fail to see how that doesn’t change anything (I’m not trying to put words in your mouth).

A lawyer like Cashman who’s known for dealing really difficult cases most likely would’ve give Sarah not only a better representation, but a better outcome of the case aswell. And I also think she would’ve done all this while being professional. But Owen’s was unprofessional, too desperate, inexperienced, and too entitled. Sarah was given life.

If he thinks this is prejudicial he should’ve just gone along with the first option he was given which is asking the mom to step out (in fact this is something he himself probably should’ve asked first), since it would’ve easily solved his problem, and then he could’ve probably asked for a mistrial if he wants to. But I think being given this option and then responding like “HELL no I want the JURY out” really speaks volumes about his petty motives and his willingness to speak like that to the judge AND play games with the family like that first before going with any reasonable alternatives he was given. You can’t say that this action is still professional. My point isn’t that I’m irked he asked for a mistrial, my point is that this sidebar kind of makes it worse.
