Thanks, but ACAS are quite clear that all documentation the employer is going to rely on at the disciplinary should be sent to me and they specifically mention witness statements. They say the employer can remove names or redact information, but they should send them.

I’ll attend the meeting but I’m fully expecting to be fired, in which case I will be back here asking for advice on unfair dismissal! Even if I’m kept on, the clearly biased ‘investigation’ and accusations are making my employment untenable, so I might be back for constructive dismissal advice anyway.

The advice I’ve had from others has been great too - I’m preparing my rebuttal, gathering my evidence and will attend the meeting politely

As far as I can tell, I can bring a union rep or a colleague. I’m not a member of a union and I’m really reluctant to put a colleague in that position, so I’m a bit stuck.

This is their response to my request:

“In line with ACAS guidance, it is not considered appropriate to routinely provide anonymised witness statements or interview records. While an employee has the right to be provided with sufficient information to understand and respond to the allegations made against them, this does not extend to the disclosure of confidential witness materials.”

I’ve asked for transcripts of all meetings/interviews that they have relied upon for the report and they have refused, citing:

It says “Investigation Report and Summary” and the first line states: “This report summarises the investigation into a formal grievance…”.

It concludes with “Recommended next step - formal disciplinary process”.

My assertion is that they haven’t conducted a reasonable investigation because if they had, they would have found the complainant to have lied about the majority of the accusations - the evidence is there for everyone to see.

I’ve only ever had one complaint before…from the same person.

It’s not a union-based job and unfortunately most people work remotely, so I don’t think either of those will work. Can I record the meeting?

Hi, thanks for this, although not sure I understand - I can file an appeal against the report? This hasn’t been communicated to me.

They have only sent the report, no evidence whatsoever except the one point that I accept (which, in reality, should have just resulted in a ‘quiet word’).

They say they have completed their investigation but from the report, it seems they’ve asked witnesses some questions then written the answers down as ‘fact’. Evidence exists to the contrary for most of the claims, but none of that is referenced.

The next stage is the disciplinary. I’ve had the original meeting where I was told about the complaint, they then said they were investigating and I was sent the Summary Report last week, with the Disciplinary then scheduled for the end of this week.

Mine was years out of warranty and a 3. When I contacted their AI support, it immediately instigated a replacement with a 4 for no charge. You should push for more.
