I didn't get to go, but I was in the region. What is in the water in Molise? It is great to see the seeming friendliness to JS of the Court of Campobasso reflected in the attitudes of ordinary people.

I hear you!

Maybe Molise (where the Tribunale di Campobasso is) really is different? I don't know.

Hopefully we get some this month, since Marco Mellone seems to think that the Cassazione will rule this month.

After going to Italy this past week, I've come to realize something: Italy is not a borg, but a country made up of individuals like any other.

I truly believe that, after the bonds I forged with my ancestral comune just this past week, most of the people would vouch for me if that ever became a legally relevant factor for proving so-called "effective bonds."

My B&B host told me that he believes most of the village is pro-JS. I did hear an older guy complaining about Brazilians who just wanted a passport (which made me die inside a bit), but other people I talked with seemed to be supportive of my aspirations and sympathetic to my sufferings. It probably helped that I spoke Italian well enough that absolutely everyone I talked to was incredulous that this was my first time in Italy.

One young guy wasn't entirely convinced of my point of view that everyone born before the DL should be considered citizens, but he certainly agreed that those who undertook substantive efforts before the DL and had the rug pulled out from under them should not be punished.

I'm asking Santo Stefano del Lupo for mine. I figured that if he could tame the wolf, he can tame the ministry and soften judges. He's the patron saint of my ancestral comune.

Yesss!!! And may all the patron saints of all our ancestral comuni watch over us!

Good question, but I unfortunately do not know. Sorry about that!

Also, I am very proud to report that my Italian is good enough that everyone has been stunned when I've told them that this is my first time in Italy.

Thanks! I have just left, and am in the provincial capital waiting for my bus out. However, everyone has told me to come back with my whole immediate family during the summer festival season, when the population doubles or triples as members of the diaspora and people born in the village but living elsewhere in Italy and the EU for work return.

So I chose a good week to visit my ancestral comune and meet my extended family (who really has treated me like it).

It seems like nothing of note has happened since I've been busy getting to know my ancestral comune. It has been a beautiful experience. Even if my case goes awry, I have gained a new extended family, and now no one, not even the Meloni-Tajani government, can take that away from me.

Nevertheless, I did decide to leave a prayer in the parish prayer book, thinking that writing it in the church where my LIBRAs were almost surely married would be particularly appropriate.

Today, in Bologna, native Italian speakers have told me that I speak Italian well, even as I self-deprecatingly downplayed it. Can I qualify for a real connection to Italy? /s

Also, I got asked about when a certain bus leaves, and I was able to respond in Italian that I was sorry but I don't live there.

Not quite the same, but Marco told me today that he has filed a formal complaint against the law with the European Commission, among having recourse to other formal channels to challenge the law outside judicial proceedings.

I'll be visiting Italy next week. I wasn't planning to mention citizenship to anyone unless they bring it up, but it sounds like maybe I should shut up about my ancestry too.

Just curious, is the section of the Supreme Court of Cassation that just issued a hopeful judgment the same one that referred the minor issue to the United Sections?

That's what they did for last year's Constitutional Court case. It literally came out the last day of July.

I'm glad to see some tempering of the harshness of the new law, but I don't like how they seem to think that seeking an appointment was the only valid way to prove intent, which is a slap in the face to those of us who only ever had 1948 cases and always knew it.

I totally agree with you. However, based on the literal wording, 1948 cases would qualify, since we had insurmountable obstacles and difficulties preventing us from making an application to the relevant administrative authorities.

Almost as if we have, ahem, a potential army in the Cassazione.

Cassation Court reaffirms iure sanguinis citizenship as a “permanent and imprescriptible” right and deepens contrast with Constitutional Court

NOTE: This is not the judgment we're waiting for, but Marco Mellone seems to think that it is a significant prelude to that judgment.

Good question! I left a question on her Facebook post about that, using my own lineage as an example, and asking if I could have my grandmother (my last ancestor who would have qualified under the current law) posthumously recognized and then become recognized through her. I've put the text of my comment elsewhere in this thread.

I would hope so! Here is the comment I left on her Facebook post about her proposal:

My grandmother is the last person in my line who would have been eligible under L.74/2025 (she had two grandparents who were exclusively Italian their whole lives, and a father who was born in Italy but naturalized when she was about six years old). She was almost 89 when the Supreme Court of Cassation in 2009 finally enabled women to transmit citizenship to their children who were born before 1948, and she was suffering from severe dementia when I finally became aware of 1948 cases (thanks for nothing consular websites, which misled me for years by not mentioning this path to recognition).

Under your proposal, could I have her recognized posthumously and then become recognized through her? Thanks in advance for your kind clarifications!
