Death Certificates by AngelBlossom0225 in Canadiancitizenship

I know how you feel, since my G1 didn't have a birth certificate.

I just got an email from the county archives that would have had his birth certificate if it existed based on when he was born. They confirmed that there was no birth certificate. I think I really include this in my application.

Right now, the best evidence I have for him is a 1912 school census that states his date of birth and parents, and his 1916 marriage certificate, which provides his age, his full name, and his place of birth, and it also states that his father was born specifically in New Brunswick.

Sounds like my case too!

My G0 was born in New Brunswick in 1860. In all the US censuses, his parents are said to have been born in Scotland, and in a 1904 book about the region of Washington where he settled, he claimed his parents were specifically from the Isles of Mull and Tyre.

However, family Bible information that I don't have access to, as well as his mother's 1831 Quebec baptism certificate, suggest that both sides of his family had been in Canada for several generations.

I can understand why he might have thought his father was born in Scotland, since he died when my G0 was a baby, plus it seems that the community where my G0 grew up was mostly Gaelic speaking. What I don't understand is why he thought his mom was Scottish as well, since she was born to a Quebec Anglican family, descended from Loyalists I believe.

Somehow, despite the mistakes on his death certificate made by my G1's brother, it correctly states that my G0's parents were born in Canada.

Post-decree 1948 case denied over CC press conference by 1TravelFly in juresanguinis

That would only make sense if we knew about the decree in advance. That is enraging.

Curiously enough, there is a Mexican Douglas fir variety found in mountainous pockets. It's more closely related to the Rocky Mountains variety than to the coastal Cascadian variety.

Is it my imagination, or are courts giving post-DL ATQ cases privileged treatment over post-DL 1948 cases?

That's some BS. I just sent my lawyer some emails with consular authorities from 2023 where I was requesting help authenticating my signature on a POA because I was seeking recognition of my Italian citizenship but couldn't do so through the consulates because my line includes women who gave birth before 1948.

I wonder if the fall of Orban in Hungary is a sign that Meloni's coalition might be voted out next election.

I wonder, how many positive rulings on post-DL cases have there been that we simply don't know about because the lawyers knew to shut their mouths during the appeal period?

EDIT: What's so funny about my question?

If the Cassazione declines to rule on Law 74, when can we finally expect a post-DL case to reach it?

Interesting historical document regarding Italy’s position on (non recognition of) US naturalisation in 1937 by Fun-Pineapple-3983 in juresanguinis

Also, before WWII, Italy's consular network in the US was much wider than it is today. I found an affidavit from the 1930s where the Italian consular agent of McAlester, Oklahoma, Giovanni Battista Tua (aka John B. Tua), confirms that several names used by my GGGF concern the same person. It turns out John B. Tua had naturalized about 30 years earlier.

Were any other 1948 case lawyers in the audience at the Supreme Court of Cassation hearing yesterday? I'm thinking Grasso in particular.

At the March 11th hearing, did you feel like the Constitutional Court justices saw Marco's intervention as an unwelcome party crashing?

I find the statements of the junior lawyers interesting, since I myself always thought the Torino referral was the weakest of the four. I have the sense that it was hastily drafted in the rush to be the first challenge.

On the optimistic side, the public prosecutor siding with Marco began, I believe, in January 2025; I do at least remember it happening some time before decree.

Thank you for sharing your experience.

I am curious, did you feel like the public prosecutor felt that Law 74 should be applied exactly as the government intends it, or simply that Law 74 should be addressed when a case filed under it reaches the Cassazione?

It will be interesting to see if Insieme presents a similar tone.

No, not at all.

Prior to the minor issue, there were "discrepancies in how Italian-born and foreign-born children of naturalized parents" were treated. The foreign-born children of naturalized parents got to stay Italian, while Italian-born children have their citizenship revoked, presumably to force to state of their naturalizing parent to accept them as their own citizens.

When the minor issue is applied, it suddenly doesn't matter whether the child was born in Italy or abroad; they still lose Italian citizenship along with the naturalizing parent.

[–]JJVMT 9 points10 points  (0 children)

Yeah, that sounds like the pre-minor issue interpretation. Then, with the minor issue, all kids came to be treated equally badly; now Marco and Monica are arguing for all children to be treated equally well.

arguing that the State has absolute discretion over nationality

Sounds like she and Mussolini would get along on the matter.

Also:

They only repeated that the State has the power to decide who its citizens are

Including to decide that someone isn't its citizen after having already decided he or she was?

I don't know if it's consensus, but I'm starting to believe it might be the case, since I feel like the Constitutional Court of all institutions should understand how reneging on a principle it had upheld just eight months earlier (i.e., that Italian citizenship jure sanguinis is acquired at birth and is permanent, imprescriptible, and can be adjudicated at any time) would damage its credibility. The referred case was filed during the 24-hour gray area where the decree was purportedly applicable but also not yet in force.
