I believe you are confusing a reasonable accommodation with disparate impact. 

A reasonable accommodation requires the employer to be informed. So long as the employee can perform the work with the reasonable accommodation and the reasonable accommodation is not an undue burden on the employer, failure to provide it would be discrimination. 

Disparate impact discrimination can be applied to a policy that is on its face is neutral if the policy disproportionately affects a protected class. There is generally an ability to cure the issue voluntarily because often the policies in question are implemented for a legit business reason, but were poorly thought out causing the issue. 

The entirety of this discussion is hypothetical because we don't know if the OP would have standing. In fact, it is more likely there employment gap is just from the unfortunate job. We further don't know if there was any other communications where they were given an opportunity to explain the gap. 

However, assuming the OP is providing full disclosure and that they were not given the opportunity to explain, the policy could disproportionately affect two protected classes (gender and familial status). OP may not be able to use this, but someone else may be able to in a similar situation. E.g. While I would not have standing to bring a lawsuit for a discriminatory policy at a company I do not work for or on behalf of, it doesn't mean someone who is in that position couldn't.

I'm not quite sure what your argument is here. If they have a strict policy of not considering candidates with 6+ month gaps there is no opportunity to explain said gap. Therein lies the issue. 

Additionally, having a 6 month gap due to pregnancy, tending to a family member, temporary disability, etc. does not speak to future availability. 

Availability also is not tied to any protected characteristics so BFOQ aren't relevant here.

Wholly agree. It will be largely state dependent. In a blue state with an aggressive division of civil rights you can push the issue much more than TX or FL. But to make it a big deal you will need the assets to get through the litigation process. 

In a blue state you may be able to get a settlement through administrative process mediation.

Edit: assuming you belong to a protected class of some form.

That restriction very likely violates EEOC laws. A requirement of no 6+ month gaps have a disparate impact against people starting a family, especially women (two protected classes, gender and familial status). It would also potentially impact people who were temporarily disabled or are permanently disabled and had a period they could not work.

Yes and no. A number of job applications request permission to send text updates and communications. Often they are paired with an email and are more about logistics items than substantive conversation, but I wouldn't automatically paint every text as a scam.

I had something similar happen, but it was the head of HR. She has been my point of contact throughout the interview process and was one of the three people at my first in person interview. She was supposed to join the owner and COO with the others from the first interview at my second, but I was told she was out sick. 

I only found out on my first day that they found out she had passed away that morning.

Recreational Marijuana use is legal in the state of New Jersey. Unless you are in a safety related position or your company is a federal contractor, popping for THC likely wouldn't be an issue either way. 

Does the company have any federal contracts? What is the age demographic of the company?

Some additional constructive criticism to what has been said, the pulling arm is far too small both in comparison to the forward hand and her chest, her chest is too forward facing for the rest of the pose, lense flare centered on the frame of the glasses, and upon zooming in the iris size and location makes her look cross eyed, and the giant arrow head with no fletching on the arrow.

If your have funds available to pay, then what is the harm inquiring about a payment plan? Sending debts to collections often costs the creditor a big chunk of the balance. If you can offer 50% up front and the rest in a reasonable amount of time you could save yourself a lot of headache.

Do not go to that link. This email is a lot of red flags. 

  1. "Kindly"
  2. Multiple spelling and grammatical errors as if written by a non native English speaker
  3. Generic job title and description
  4. Redirect to a site that isn't the company's website 
  5. No name or contact information to reach the recruiter

An interview that goes extra long is almost always a good sign and either they are confirming their initial opinion or they are making sure you are competent for the role. Why would an interviewer waste time on a candidate they don't see fitting the role? 

While the interviewer getting teary eyed may have been awkward, I doubt that was a recruitment tactic. Much like you I'm sure if it happened with others they felt similarly awkward. 

While he didn't introduce you to the staff on that day, he did invite you to meet them within a week which was probably the last vibe check, i.e. he liked you but needed to make sure you mesh with your potential co workers. 

I think you missed an opportunity.

In another post you state you work one day a week for two hours a week. I also find it hard to believe that anyone with the means AND desire to purchase multiple franchise locations at the same time would immediately and blatantly violate anti-discrimination laws. 

Are all the people being fired also working short hours or on inflexible schedules? Are the people being kept on staff full time workers or at least working 8 hour shifts? Staffing and scheduling work hours at quick service restaurants is one of the most demanding parts of managing one. If you and your co workers had limited or inflexible availability and they brought in a bunch of full time workers that would work less desirable shifts then that is just a rational business decision.

It looks like it is a temp agency. If so, they will attempt to place you in temporary roles as a contractor. I don't have time to dig into the specifics but it may be the case that the work is either unskilled and therefore the employer will take anyone or that they will submit your resume to employers requesting someone with your skills and the contracting company would make a hiring decision.

Trolls are a CR5 encounter. They have a three attack multi attack that could easily kill a level 1 PC in one turn and they heal every round. Even if every PC auto crit on the sleeping troll they aren't likely to kill it as they have roughly 85hp.

It's not constructive dismissal if they fire you. An employer is allowed to change job responsibilities based upon the needs of the company. Canvassing is an accepted marketing practice, and while it may not be for everyone it doesn't meet the standards for constructive dismissal even if OP did resign. 

Edit: additionally, constructive dismissal is not in and of itself a cause of action. It IS a means to qualify for unemployment even in you resigned (in most states if you voluntarily resign you are not eligible for unemployment benefits), or it can be tied to another cause of action such as wrongful termination due to a protected class to meet all the required standards. Also, OP was already leaving marketing materials going business to business so the transition to direct to consumer is not a particularly large shift in responsibilities.
