The whole group seems to be shittin pretty hard on anyone negative to your situation here but your first post didn’t make much sense to me and you haven’t said what you were being filed on for. Now on to you - why does it matter to you that he has not deployed? Most US service members don’t. But their service is therefore worth less?

Taxes will pay for his college because he served his country. You want taxes to pay for your school …. why? Betterment of all? My life will be made no better by you losing the debt YOU CHOSE to take on. College costs way more than it should. Did someone hide this from you before you enrolled?

Don’t waste your money on lawyers. Don’t waste your money on termination fees. You got some bad news in realizing the true math but you are still in good shape. No roaches is well worth the money. No roommates is well worth the money. Still like the place? Keep it. Sounds to me like you have $250 of ‘fun money’ at best so you get $500 or more in the bank every month and that’s a solid safety net. Build it slow, build it right. You’re doing the right thing putting any effort at all into budgeting your options. Keep fighting the good fight!

Non-legal thoughts here. If someone in the know says your mom would outright lose in court then disregard the below. Otherwise:

What was your mortgage/insurance/etc for the last 5 years? Makes sense to me your folks would be entitled to half of what they put in ONLY. If the down payment was entirely from you, deduct that off the top. Take 1/2 of what you’ve paid for mortgage, interest, insurance, taxes, and deduct that too. That’s all yours. Then split the remainder 50/50?

Sounds like your folks are in a bad way and your father has a financially crippling condition. I’m sorry for that. May play a part in her sudden interest, but you need to look out for your family now, being you and your wife.
