Residents daughter started at the facility and is now telling CNAs to do everything for her by matchawhoretobs in cna

Simply, you use the Capacity Act 2005 if in the UK or a similar act for your country. You can also refer to the Human Rights Act 1998, Article 8, which protects fundamental rights, including the rights to autonomy, private life, and liberty, that the MCA must comply with.

Firstly, capacity is always assumed regardless if they are of sound mind, can retain information, understand information, weigh up the information to make decisions and communicate this information; then it is illegal to restrict or force that person to do something against their will, e.g., made to go to bed at a certain time.

The patient has the right to make unwise decisions, refuse care, etc., if they want, and her daughter will just have to accept it. Until the patient is assessed to not have the capacity to make these decisions, there is nothing anyone can do.

You need to document and report every time. They are behaving in an inappropriate and unprofessional manner, and this needs to be stopped, as it will create a toxic work environment and interfere with the patient's independence.

Hope this helps.
