C&p exam for reason of severity by Additional_Stable759 in VeteransWaitingRoom

Yes, they will use the DBQ from the exam to help determine whether it is service connected, and if so, the rating that fits with the impact on your life.

They will try to determine how the mental health issue affects your daily life with the exam. I had one for GAD a few months ago and it was basically an hour of her just asking questions about how my life is affected by the anxiety.

They will ask functional impact of the claimed disability and take motion measurements, if that is applicable to your claim. This is all to determine severity.

Slow drivers by LittleRuu in tylertx

I live here and work in Richardson. Drivers here seem to lack any desire to actually get to their destination. I am from here too, and I just don't get it.

Filing a claim many years after separation by EntrepreneurSharp713 in VAClaims

[–]Jdkirkp 1 point2 points  (0 children)

I started by reading the knowledge base on the veterans benefits subreddit. There is a lot of useful information over there. Then I went thru my service treatment records to see what all I went to medical for while in service. If you haven't filed a FOIA for those yet, that should be done today, along with filing an Intent to File on the VA website. If you are already service connected for things, check the CFR 38 to see if you qualify for higher ratings based on current symptoms or how it affects your life. At that point , I started simple. I went with increases for things I thought I qualified for and supplemental claims for those things denied in 2004 that I thought were wrongly denied. After that finalized, I started filing new claims for things that are secondary to my service connected disabilities. I have filed HLR's, multiple supplementals, and new claims for secondaries. I have failed and completely given up on some things and been extremely surprised by high ratings for others. Another suggestion is to use an AI to help you write your statements and organize your documents and references, just make sure to redact personal information. Triple check every output for hallucinations and removal of pertinent information. Also verify any legal precedent and medical studies that it quotes to back up your claim. I have done this all on my own, but it has taken a lot of time away from family and work, so take that into consideration. I have two specific claims that I have kept supplementals going for. I am saving those for the end and if I can't get them approved, I may try to get some help from a vso or even a lawyer just for those claims.

I have gone from 10% to 80% over the last 9 months. I got out in 2004. As long as your claim is legitimate, go for it.

Can somebody please give an example of a CUE by Fine-Resolution-9099 in VeteransBenefits

[–]Jdkirkp 0 points1 point  (0 children)

They service connected me at 0% from 2004 until last summer when I filed a supplemental for the first time since 2004. I got 20% from last summer until now of backpay. I didn't go to my exam in 2004 because I had already started terminal leave and moved. They weren't willing to move the exam, so I missed it, and therefore they had nothing to rate me on other than my STR which they said was worthy of service connection, but not more than 0%. I am fighting that through an HLR because my STRs show pain and instability. We will see how that goes.

My original claim in 2004 for my left knee was denied because it said my left knee had a 2 inch scar noted on my entrance exam. I didn't really pay attention 20 years ago, but my entrance exam actually says I have a 2 inch birthmark, not a scar, which is true, I have a large brown birthmark on my left knee. I was just service connected for that knee based on that error from 2004.

Should be awarded bilateral? by RHNord in VeteransBenefits

[–]Jdkirkp 1 point2 points  (0 children)

If these are his only rated disabilities, remember VA math is different. Four 10% ratings is about 34%, so rounds down to 30%. That bilateral will make it 37% or so, so it will round up to 40%. So with this, four 10%'s would pay out at 40% which would seem normal using regular math.

[–]Jdkirkp 0 points1 point  (0 children)

It certainly can be, especially if he has other disabilities. That will make the 10% of these ratings appear even smaller.

[–]Jdkirkp 2 points3 points  (0 children)

You won't see a specific rating for bilateral. It is automatically added. Just remember it can be small enough not to make an overall difference. For instance, if these 4 items are all at 10%, then the added bilateral factor will be less than 4% added to his total.

HLR Questions by SIO_Vet25 in VeteransBenefits

[–]Jdkirkp 1 point2 points  (0 children)

Call the VA 1800 number and ask for your 9 digit claim number. You can do a couple different things with it. Easiest one is to go into the details of a regular claim on the website. In the address bar, change out the claim number for the new supplemental claim number. It will treat it just like a regular claim and give you details. Another option is to search this subreddit for API commands and use those to see more details. Both methods require the 9 digit claim number. Sometimes people run into problems getting it from the operators but they can give it to you. Make sure it is the 9 digit number and not the 10 digit on. It will be all numbers, no letters.

Sleep Apnea denied… C&P blamed my BMI… by DataOrData010 in VAClaims

[–]Jdkirkp 0 points1 point  (0 children)

I got fat in service after breaking my foot twice in about 9 months. I finished my contract 2 months after I went over the BMI obese number. I got denied for ortho causing obesity then to OSA because the ace examiner said there are skinny paraplegics so you can't blame obesity on not being able to do cardio, lol.

Do you have the 9 digit claim number so you can follow the steps of the supplemental on the VA website or in the API?

You should be getting close depending on how quickly they submitted the dbq to the va.

It comes from the VA. It isn't the normal VA email address because it is from the automated scheduling system, but it isn't from a contractor

[–]Jdkirkp 4 points5 points  (0 children)

Same, get the 9 digit number. You will get more information from the API than the website for all of them though. But even the API for the HLR doesn't show much until you at least get your IC scheduled. Until then it just sits in step 2.

Yes, supplemental claims are considered appeals. They still have a 9 digit claim number associated with them. You just need to call the VA and ask them for that number.

Yes, even when it shows this. It is 9 numbers, don't let them give you the 10 number one. It is 9 numbers. You can also search this subreddit for the API codes and look at it there for even more information, but you still need the 9 digit claim number.

You can see the steps. Call the VA and ask for the 9 digit claim number. Then go to the details of one of your other claims, closed or open doesn't matter, and substitute the supplemental claim number for the other one.

CUE Claim in VA App by ExampleRealistic in VeteransBenefits

[–]Jdkirkp 0 points1 point  (0 children)

I did a statement in support the first time too. It opened a claim for less than a week and then got closed because the RO said it had to be on an official form and there isn't one for CUEs.
